Sec. 2. And be it further resolved, That in ease the Rock Island and EXiS'>*¤Sl”idE° Pacific Railroad Company shall neglect or fail, for sixty days after the gzgilggurgggge passage of this resolution, to make and guarantee the agreement specified bum, and road in the act of appropriation aforesaid, approved March second, eighteen ;‘P'L;°O;.":; if hundred and sixty-seven, then the Secretary of War shall be, and is y’ ’ hereby, authorized and required to direct the removal of the existing bridge and to direct the construction of the bridge aforesaid, and expend the money appropriated for that purpose in said act; and the said Rock Island and Pacific Railroad Company shall not have, acquire, or enjoy any I right of way, or privilege thereon, or the use of said bridge, until the agreement aforesaid shall be made and guaranteed according to the terms and conditions of said act of appropriation.
