That nothing in this act contained shall be so construed as to authorize said Olmstead to receive any pay or allowances for any time that he has not been in the actual service of the United States. Preston July 25, 1676- Be it enacted by the Senate and House of Representatives of the United Swm of America in Congress assembled, That Albert W. Preston, who Aibm W· 1;f<>¤· was, on December fiftccntb, eighteen hundred and seventy, duly retired 1’_;gkf)‘;“;;;: 61 :3 from the active service, and placed upon thelist of rotinmi officers of the the miwd,1m 0; United States Army, with the full rank of colonel, on account of wounds Amy. received in battle while performing the duties of colonel in command of his regiment, be, and hereby is, excepted and relieved from the operations of tho act of Congress entitled "An act; for the relief of General }g7g£'·gg· _ Samuel W. Crawford, and to Hx the rank and pay of retired officers of " ' tho Army," approved March third, eighteen hundred and seventy-tivo, solely because the injuries received by him in battle are more severe, dangerous, and disabling, and more fully iucapacimm and disqualify him for any service, than the loss of an arm or log, or the permanent disability of an arm or leg by resection and is hereby restored upon the list of retired 050crs of tho Army, to tho full rank of colonel, held by him from tho date of his retirement, up to March third eighteen hundred and seventy-tivo, with tho pay of such rank from tho date of the passage of this act, and shall heroafwr hold and momvo the rank and pay of colonel upon the list of retired officors of tho Army.
