   Be it enacted by the Senate and House of Representatives of the United

~$2“'¤W 1***1* States ofAmcr£ca in Uongress assembled, That the Tombigbco Railroad th0dz;{"'§,“fu§3;g Company, a corporation created and existing u11dcr and by viytuc of Tgmbigbgg giver, the laws of tho State of Mississippi, bo, and is hereby, authorized to Columbus, Min. build a bridge across tho Tombigbce River in the State of Mississippi, at such point as may hereafter be selected by said railway company for crossing said river at or near Columbus with its railroad line, tho said bridge to be so constructed as not to iutortorfcro with the naviga- ‘ hwm. tion of said river: Provided, That any bridge constructed under this act T0 M =¤ kwful and according to its limitations shall be a lawful structure, and shall

That any bridge constructed under this act shall be built and to ¤·PP¤'°'° Pl¤¤¤» located under and subject to such regulations for the security of naviga- °t°‘ tion of said river as tho Secretary of War shall prescribe; and to secure that object the said company shall submit to the Socrotaxy of War, for his oxamination and approval, a. design of the drawings of tho bridge and piers, and a map of the location, giving, for the space of at least one mile above and one mile below tho proposed location, the topography of tho banks of tho river, tho shorcdinos at high and low water, and the direction and strength of tho currents at all stages, hud the soundings, accurately showing tho bed of the stream, the location of any other bridge or bridges, and shall furnish such other information as may be required for as full and satisfactory understanding of the subjects; and until said plan and location of tho bridge are approved by the Secretary of War the bridge shall not be built; and if any changes bo made in tho plan of construction of said bridge during the progress of the work thereon, or before the completion of said bridge, such change shall be subject to the approval of the Secretary of War; and the said structure shall be an all times so kept and managed as to other reasonable and proper means for tho passage of vessels through or under said ` structure; and tho said structure shall be changed, at the cost and expense of tho owners thereof, from time to time as Congress may direct, so as to preserve the free and convenient navigation of said river; and the authority to erect and continue said bridge shall be subject to tho revocation or modification by law whenever tho public good shall, in tho judgment of Congress, so require, without any expense or charges Litigation, to the United States ; and in casa of any litigation arising hom any obstruction or alleged obstruction to tho free navigation of said riwr caused or alleged to be caused by said bridge, suit may be brought in tho circuit courts of the United States of Mississippi in whose jurisdxc- _ tion any portion of said bridge may be located. “°m§];:a*rQ:5"°°d» Sec. 3.
