FIFTY-SIXTH CONGRESS. sms. 11. cn. sos. 1901. 907 building wharves; transportation of funds of the Armg; the eizfenses of sailing public transports on the various rivers, the ulf of exico, and the Adlantic and Pacific oceans; for procuringlwater, and introducing the same to `buildings, at such posts as from their situation require it to be brought from a distance, and for the - disposal of sewage and drainage, and for constructing roads and wharves; for the payment g,§g§'}.*},'§§‘r§m‘{Q,_ ‘““d° of army transportation lawfully due such land-grant railroads as have not received aid in Government bonds (to be adjusted in accordance with the decisions of the Supreme Court in cases decided under such ;§},'},,‘{,’Q,‘,}{,';,°;,(,n, how land·grant Acts), but in no case shall more than fifty per centum of ¤¤mx>¤¢<·=<1· full amount of service be paid: Pro/vided, That such compensation shall be computed upon the basis of the tariff or lower specia rates for like transportation performed for the public at large, and shall be accepted _ as in full for all demands for such service: Provided, further, That in ,,}rf,§§d,p°§0§°“§0,‘§ expending the money ap(pr0priated by this Act, a railroad company ¤id¤d· which has not received a1 in bonds of the United States, and which obtained a grant of public land to aid in the construction of its railroad on condition that such railroad should be a post route and milita road, subject to the use of the United States fO1‘ postal, military, navdls; and other Government services, and also subject to such r%·ulations as Congress may impose restricting the charge for such overiiment transportation, having claims against the United States for transportation of troops and munitions of war and military supplies and property over such aided railroads, shall be paid out of the moneys appropriated by the foregoinghprovision only on the basis of such rate for the transportation o suc troops and munitions of war and military supplies and proiperty as the Secretary of War shall deem just and reasonable under the foregoing provision, such rate not to exceed fifty er centum of the com ensation for such Government transportation as shall at that time be charged to and paid by private lparties to any such company for like and similar transportation; and the amount so fixed to be paid shall be acce ted as in full for all demands for such service, thirty- four million d)ollars: Provided, That the balance of the appropriation Uugxxglqied balof one hundred thousand dollars made by the Act of May twenty-sixth, iiiiifiiiisira aitdiiiiaiigfls nineteen hundred, for construction of military roads and bridges in Am- P- 21*- Alaska remaining unexpended on June thirtieth, nineteen hundred and one, is hereby reappropriated and made available for sucl: construction: Prooided further, That the number of draft animals urchased drgpjgigygber Of from this appropriation, added to those now on hand, shall be limited ` to such numlliers as are actually required for the service. .
