Be it enacted by the Senate and House of Rqwesentatives of t/ie United [Private, No. 136.1 States of America in Congress assembled, That in the administration Jams McKenzie. of the pension laws and the laws governing the National Home for mlgigéiary md °°r` Disabled Volunteer Soldiers, or any branch thereof, James M cKenzie, now a resident of Iowa, shall hereafter be held and considered to have been honorably discharged from the militar service of the United States asa private of Company D, First Battalion, Eleventh Regiment United States Infantry, on the twenty-sixth day·of August, eighteen hundred and sixty-tive: Provided, That no pension shall accrue prior f,,’Q,"£'_@'j;, P€m,0,__ to the passage of this Act. l Approved, June 25, 1910. CHAP. 448.-An Act For the relief of the owners of the American schooner ‘?ff°£5;5g§%‘ Wilson and Hunting and cargo. Be it enacted by the Senate and House of Representatives of the United Hwa States 0 f America in Oonyress assembled, That the claims of the owners of scS§§0°iii§i_ Hmm the American schooner Wilson and Hunting and of the cargo on board c0§§§*;§,'§§ {§{,§‘*[‘}‘“g°§· of her, sunk by collision with the United States steamship Culgoa, off "G¤1sg¤." referiedté Barnegat, New Jersey, on or about November ninth, nineteen hundred gi;l;1xv·ictg;i(1n?0umuu and four, for and on account of the loss of the said vessel and cargo, may be submitted to the United States district court for the southern district of New York, under and in compliance with the rules- of said 0011113, sitting as a court of admiralty, and the said court shall have jurisdiction to hear and determine any suits brought, and to enter a ]udgment or decree for the amount of any damages for the loss of the said vessel`and cargo, if any shall be found to be due, against the United States, upon the same principles and measure of liability, with costs as in like cases in admiralty between private parties, and with _ the same rights of a peal: Provided, That the amounts of the losses {_`§$,,,m,,,,,,,,,d sustained by the odibers and crew of the said schooner Wilson and ¤¤=w· Hunting may be included in the decree of the owners of the said vesse . Sec. 2. That notices of the suits shall be given to the Attorney- D°“’“°°· General of the United States and to the Secretary of the Navy, as may be provided by the order of the said court, and it shall be the duty of the Attorney—Geneial to cause the United States attorney to appear for and defend the United States. Sec. 3. That should damages be found to be due the said owners of p,’§I’,§°,§‘§l’,f;i§Y{,‘Z,'§,t_ ‘°' said schooner Wilson and Hunting and cargo, the amount of the final decrees therefor of any or either of them shall be paid out of any money in the United States Treasury not otherwise appro riated: _ Provided, also, That such suit shall be brought and commenced) within {—)'{,'§”Z°§5,,.m_ four months from the date of the passage of this Act.
