PROCLAMATIONS, me. 1961 kill or seize and capture migratory birds within the protection of this law during said closed seasons, and any erson who shall violate any of the provisions or regulations ofp this law for the protection of migratory birds shall be guilty of a misdemeanor and shall be fine not more than $100 or imprisoned not more than ninety days, or both, in the discretion of the court. The Department of Aggiculture, after the preparation of said pelgulations, shall cause the same to be made public, and shall ow a period of three months in which said regulations may be examined and considered before final adoption, permittin , when deemed propler, public hearings thereon, and after final ado tion shall cause the same to be engrossed and submitted to the Fresident of the United States for ariprovalz Provided, however, That nothing herein contained shall e deemed to affect or interfere with the_ local laws of the States and Territories for the protection of nonmxrgratory game or other birds resident and breeding within their be ers, nor to prevent the States and Territories from enacting laws and regilations to promote and render efficient the regulations of the epartment of Agriculture provided under this statute. Dnrmmons. For the purposes of these regulations the following shall be con- D°°°‘“°"* sidered migratory game birds: (a) Anatidm or waterfowl, including brant, wild ducks, geese, and swans. (b) Gruidae or cranes, including little brown, sandhill, and whooping cranes. _ 85;:) Rallidaa or rails, including coots, gallmules, and sora and other r . (d) Limicolae or shore birds, including avocets, curlew, dowitchers, godwits, knots, oyster catcher:-hphalaropes, Ilgover sandpi ers, snipe, stilts, surf birds, turnstones, et, woodcoc , and yellowllegs. (e) Columbidae or pigeons, including doves and wild pigeons. For the purposes of these reiulations the following shall be considered migratory insectivorous irds: Q`) Bobolinks, catbirds, chickadees, cuclgoos, iiickers, ilgatchers, osbeaks, humming birds, kinglets, martms, meadowlar · , nightiiwks or bull bats, nuthatches, ornoles, robins, shrikas, swallows, swifts, tanagers, titmice, thrushes, vireos, warblers, waxwings, whipoorwills, woodpeckers, and wrens, and all other perching birds which iiced entirely or chiefly on insects.
