[CHAPTER 654 .] AN ACT To amend the Air Commerce Act of 1926 and to increase the efficiency of the Aeronautics Branch of the Department of Commerce with respect to the development and regulation of civil aeronautics . Be it enacted by the Senate and House of Representatives of the United States of Ame rica in Cong ress ass embl ed, That subdivision (d) of section 2 of the Air Commerce Act of 1926 (U .S .C ., Supp. VII, title 49, s ec . 17 2(d)) is ame nded b y inse rting before the pe riod at the end of the first sentence thereof a comma and the following `` aircraft, aircraft power plants, and accessories" . SEC . 2 . Subdivision (e) of such section 2 (U .S .C ., Supp . VII, title 49, sec . 172(e)) is amended to read as follows : "(e) To investigate accidents in civil air navigation in the United States, including the attending facts, conditions, and circumstances, and for that purpose the Secretary, or any officer or employee of the Department of Commerce designated by him in writing for the pur- pose, is authorized to hold public hearings in such places and at such times as he shall deem practical, and for the purpose of such hear- ings, a dminis ter oa ths, e xamine witne sses, r equire the p reserv ation of evid ence, and is sue su bpenas for t he atte ndance and t estimo ny of witnesses, or the production of books, papers, documents, exhibits, and other evidence, or the taking of depositions before any desig- nated individual competent to administer oaths for the purposes of this Act. Witnesses summoned or whose depositions are taken shall receive the s ame fe es and milea ge as witness es in the co urts o f the United States . All evidence taken at the hearing shall be recorded and forwarded to the Secretary . At the conclusion of an investiga- tion of or hearing on any such accident or as soon thereafter as cir- cumstances permit, the Secretary of Commerce shall, if lie deems it in the public interest, make public a statement of the probable cause or causes of the accident, except that when the accident has resulted in seriou s or fata l injury, it shall be the d uty of th e Secre- tary to make public such a statement . Neither any such statement nor any report of such investigation or hearing, nor any part thereof, shall be admitted as evidence or used for any purpose in any suit or action growing out of any matter referred to in any such state- ment, investigation, hearing, or report thereof ." SEC. 3. Subdivision (a) of section 3 of such Act (U.S .C ., Supp .
