777 [CHAPTER 289 .] AN ACT May 15, 1934 . Providing for the su spension of annual a ssessment work on mi ning claims held [S .23131 by location in the United States and Alaska .

[Public, No 226 .1 Be it enacted by the Senate and House o f Representatives of the United States of America in Congress assembled, That the provision of sect ion 23 24 of the Re vised Statut es of t he Uni ted St ates, which requires on each mining claim located, and until a patent has been issued therefor, not less than $100 worth of labor to be performed or improvements aggregating such amount to be made each year, be, and the same is hereby, suspended as to all mining claims in the Unite d Sta tes, incl uding Alas ka, durin g the year beg innin g at 12 o'clock meridian July 1, 1933, and ending at 12 o'clock meridian July 1, 1934 : Provided, That the provisions of this Act shall not apply in the case of any claimant not entitled to exemption from the payment of a Federal income tax for the taxable year 1933 : Provided further, That every claimant of any such mining claim, in order to obtain the bene fits of t his Act, shall fil e, or cau se to be filed, in the office where the location notice or certificate is recorded, on or before 12 o'clock meridian, July 1, 1934, a notice of his desire to hold said mining claim under this Act, which notice shall state that the claimant, or claimants, were entitled to exemption from the payment of a Federal income tax for the taxable year 1933

provided further, That such suspension of assessment work shall not apply to more than six lode-mining claims held by the same per- son, nor to more than twelve lode-mining claims held by the same partnership, association, or corporation : And provided farther, That such su spensi on of assess ment w ork sh all not apply to mo re tha n six placer- mining claim s not to exc eed on e hundr ed and twent y acre s (in all) held by the same person, nor to more than twelve placer-mining claims not to exceed two hundred and forty acres (in all) held by the same partnership, association, or corporation . To amend sections 203 and 207 of the Hawaiian Homes Co mmission Act, 1920 [ H .R .805 2. 1 (U .S .C ., title 48, sees . 697 and 701), conferring upon certain lands of Auwaio-

[Public, No . 227.] limu, Kewalo, and Kalawahine, on the island of Oahu, Territory of Hawaii, the status of Hawaiian home lands, and providing for the leasing thereof for residence purposes . Be it enac ted by the Senate and House of Representatives of the United States of America in Congress assembled, That paragraph Ha waiian Hom e C ommis sion Act, 192 0, (4) of section 203 of the Hawaiian Homes Commission Act, 1920 amendments . (U.S.C., title 48, sec . 697), is hereby amended to read as follows : ae>iaed12, p. 10 9, "(4) On the island of Oah u : Nan akuli (thr ee t housa nd ac res, ladon nfe g ea p more or less) , and Lualua lei (t wo tho usand a cres, more o r less ), in the status of hom e the District of ~1r aianae ; and A Vaimanalo (four thousand acres, lands . more or less), in the District of Koolaupoko, excepting therefrom the military reservation and the beach lands ; and those certain por- tions of the lands of Auwaiolimu and Kewalo described by metes and bounds as follows, to wit "(i) Portion of the Government l and of Auwaiolimu, P unch- bowl Hill, Honolulu, Oahu, described as follows : Beginning at a pipe at the southeast corner of this tract of land, on the boundary between the lands of Kewalo and Auwaiolimu, the coordinates of said po int of begin ning r eferre d to G overnme nt sur vey tr iangul ation station `Punchbowl' being one thousand one hundred and thirty- Description.
