AN ACT To am end section 3 of the Act approved May 10, 1928, e ntitled "An Act to extend the period of restriction in lands of certain members of the Five Civ ilized Trib es, an d for other purp oses", as a mended February 14, 1931 . Be it enacted by the Senate and House of Representatives of the Five Civilized Tribes, United States of America in Congress assembled, That section 3 Vol. 45,p.496; Vol. of the Act of May 10, 1928, entitled "An Act to extend the period 46, p. 1108. of restriction in lands of certain members of the Five Civilized Tribe s, and for othe r purpo ses", as amende d Februa ry 14, 1931, be amend ed to r ead as f ollows "SEc. 3 . That all minerals, including oil and gas, produced on or after April 26, 1931, from restricted allotted lands of members of the Five Civilized Tribes in Oklahoma, or from inherited re stric ted lands of full- bloo d Ind ian heirs or devis ees of su ch l ands, shall be subject to all State and Federal taxes of every kind and character the same as those produced from lands owned by other citizens of the State of Oklahoma

and the Secretary of the Interior

is hereby authorized and directed to cause to be paid, from the individual Indian funds held under his supervision and control and b elongin g to the Indian owners of the lands, t he tax or taxes so assessed agains t the ro yalty i nterest of the respect ive Indi an owners in such oil, gas, and other mineral production : Provided, That nothing in this Act shall be construed to impose or provide for double taxation and, in those cases where the machinery or equipment used in producing oil or other minerals on restricted Indian lands are subject to the ad valorem tax of the State of Oklahoma for the fiscal year ending June 30, 1931, the gross produc- tion tax which is in lieu thereof shall not be imposed prior to July 1, 1931 : Provided further, That in the discretion of the Secretary of the Interior, the tax or taxes due the State of Oklahoma may be paid in the manner provided by the statutes of the State of Oklahoma." AN ACT Be it enacted by the Senate and House of Representatives of the United States o f America in Congress assembled, That the Secretary of War is authorized and directed to cause a preliminary examina- tion to be made of the Los Angeles and San Gabriel Rivers and their tributaries; to include both drainage basins and their outlets, in Los Angeles County, Los Angeles, California, with a view to the control of floods, in accordance with the provisions of section 3 of an Act entitled "An Act to provide for control of the floods of the Missis- sippi River, and of the Sacramento River, California, and for other purposes", approved March 1, 1917, the cost thereof to . be paid from appropriations heretofore or hereafter made for examinations, sur- veys, and contingencies of rivers and harbors .
