Be it enacted by the Senate and House o f Representatives o f the United States of Ame rica in Congress assembled, That the Interstate Inters tate Commerce Act, amendment . Commerce Act, as amended, h erein referred to as "Part I " , is h ere by vl.24,p.3;s;Ii. S. amended by inserting at the beginning thereof the caption " part I , c.,p. 2211 . and by substituting for the words " this Act ", wherever they occur, the words "this part ", but such part I may continue to be cited as t h e " Interstate C ommerce Act ", and said Interstate Commerce Act is hereby further amended by adding the following part II : " PART II " SHORT TITLE Part II. 543 SEC . 201 . This part may be cited as the ` Motor Carrier Act, Motor Carrier Act, .1935 1 .

1935 . " DECLARATION OF POLICY AND DELEGATION OF JURI SDICT ION " SEC. 202. (a) It is hereby declared to be the policy of Congress to regu late trans porta tion by mo tor c arrie rs in such mann er as to recognize and preserve the inherent advantages of, and foster sound economic conditions in, such transportation and among such carriers in the public interest ; promote adequate, economical, and efficient service by motor carriers, and reasonable charges therefor, without unjust discriminations, undue preferences or advantages, and unfair or destructive competitive practices ; improve the relations between, and coordinate transportation by and regulation of, motor carriers and other carriers ; develop and preserve a highway transportation system properly adapted to the needs of the commerce of the U nited States and of the national defense ; and cooperat e with the several States and the duly authorized officials thereof and with any organization of motor carriers in the administration and enforce- ment of this part . "(b) The provisions of this part apply to the transportation of passen gers or pr opert y by moto r car riers enga ged i n int ersta te or foreign commerce and to the procurement of and the provision of facilities for such transportation, and the regulation of such trans- portation, and of the procurement thereof, and the provision of facilities therefor, is hereby vested in the Interstate Commerce Commission . "(c) Nothing in this part shall be construed to affect the powers of taxation of the several States or to authorize a motor carrier to do an intrastate business on the highways of any State, or to inter- fere with the exclusive exercise by each State of the power of regulation of intrastate commerce by motor carr iers on the highways thereof .
