(b) Sect ion 3 (a) of suc h Act, as amended , is amended by a dding at the end thereof the following new sentence : "In ascertaining the sentiment of t he producers with respect to the c rop year 1936-193 7 or the crop year 1937-1938, the vote in favor of the compulsory tax features of this Act, by two-thirds of the producers voting, shall be deemed sufficient for the purposes of this subsection ." (c) Section 5 (a) of an Act entitled "An Act to place the cotton industry on a sound commercial basis, to prevent unfair competition and practices in putting cotton into the channels of interstate and fore ign comme rce, to prov ide f unds for payi ng a ddit iona l ben efit s under the Agricultural Adjustment Act, and for other purposes," approved April 21, 1934, as ame nded, is amended by inserting afte r the sentence " that no State shall receive an allotment of less than 200,000 bales of cotton if in any one year of five years prior to this date the production of the State equaled 250,000 bales" the follow- ing : "And be it further provided that after the year 1935 no State shall receive an allotment of less than 80,000 bales of cotton if in any one year of five years prior to the date of the bales .' of said Act the production of the State equaled 100,000 bales .' (d) The action of the Secretary of Agriculture in ascertaining and proclaiming, pursuant to section 3 (a) and (b) of such Act, as amended, 10,500,000 bales as the max imu m am ount of cot ton of the crop h arvested in the c rop year 1935-193 6 that may be mar keted exempt from payment of the tax levied by such Act, as amended, is hereby legalized and ratified, and all apportionments and other action taken pursuant to such ascertainment and proclamation are legalized and ratified and confirmed as fully to all intents and purposes as if such amo unt had be en fixed a nd such a pportionme nts and a ction had been authorize d and made effectiv e specific ally by A ct of Congress . (e) Section 7 of such Act, as amended, is amended by adding at the end thereof the following new subsection "(d) For each crop year subsequent to the crop year 1934-1935 in which this Act is in effect the Secretary of Agriculture shall make (1) to each farm with an established average production for the applicable base period of 956 pounds or less of lint cotton an allot- ment equal to the full amount of such production and (2) to each farm with an established average production for such base period of more than 956 pounds of lint cotton an allotment of not less than 956 pounds . For each crop year subsequent to the crop year 1935- 1936, the amount of each such allotment (and for the crop year 1935-1936 and subsequent crop years, the additional amount required for apportionment under the provisions of the Public Resolution entitled " Public Resolution To provide for certain State allotments under the Cotton Control Act ") which is in excess of the allotment which, without regard to this subsection or such Public Resolution, w ould have been made to any fa rm, shall be in addition to the national allotment and the allotments to the State and county in which such farm is situated . The first sentence of this subsection shall not be held to increase any allotment to any farm for the crop year 1935-1936 which allotment was made under regulations of the S ecretary of Agric ulture prior to t he date of the ad option of this amendment, or to require any reallotment ." SEC . 40 . Section 17 of such Act of April 21, 1934, as amended, is amended by inserting "(a)" before the first sentence thereof and by inserting at the end thereof the following new subsection "(b) Appropriations for administrative expenses under this Act are authorized to be made available to enable the Secretary of Agri- culture to pay any person, who, in connection with the operation of A scert ainme nt of sen- timent of producers.
