Warner, an employee of the Immigration and Naturaliza- tion Service, Department of Labor, while engaged in the performance of his duties as such employee, on October 27, 1937, near Houlton, Maine: Provided, That no part of the amount appropriated in this Act, in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall be unlawful, any contract to the contrary notwithstanding. Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. SEC. 2. Payment shall not be made under this Act until the said Luther Devoe has released, in a manner satisfactory to the Secretary of the Treasury, any judgment or other claim arising out of such accident, which he may have against the said Charles T. Warner. Approved, June 6, 1940. [CHAPTER 262] AN ACT To amend an Act entitled "An Act for the relief of Mrs. A. R . Barnard, Charles A. Stephens, Donald W. Prairie, and dependents of Vern A. Needles", ap- proved July 15, 1939. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Act of July 15, 1939 (Private, Numbered 95, Seventy-sixth Congress, first session) is amended by striking out all of that portion thereof read- ing "and the sum of $5,000 to irs. Vern A. Needles, Newport, Oregon, widow of Vern A. Needles, who, as a member of the crew of the motorboat M. E. Sloan, was drowned when such motorboat was cap- sized and destroyed as aforesaid: Provided", and substituting in lieu thereof "and the sum of $2,500 to Mrs. Vern A. Needles, Newport, Oregon, widow, and the sum of $2,500 to Charles V. Needles, minor son, of Vern A. Needles, who, as a member of the crew of the motor- boat M. E. Sloan, was drowned when such motorboat was capsized and destroyed as aforesaid: Provided, That payment of the last named amount shall be made to the legal guardian of Charles V. Needles, for his use and benefit: Provided further". Approved, June 6, 1940. [CHAPTER 263] AN ACT For the relief of the estate of Lewis Marion Garrard Hale. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, the sum of $5,000, to the estate of Lewis Marion Garrard Hale in full settle- ment of all claims against the Government of the United States on account of the death of said Hale on December 29, 1938, from injuries received when struck by a Forest Service truck operated by an enrollee of the Civilian Conservation Corps: Provided, That no part of the amount appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall be unlawful, any contract to the contrary notwithstanding. Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000.
