The Acting Secretary of State to the NicaraguanAmbassador DEPARTMENT OF STATE WASHINGTON October 25, 1943 EXCELLENCY: I have the honor to acknowledge the receipt of your Excellency's note of October 22, 1943, in which you refer to the negotiations which have taken place between the Government of the Republic of Nica- ragua and the Government of the United States of America relating to the Agreement between the two Governments which was signed 55 Stat. 327 . in Washington on May 22, 1941 for the detail of an officer of the United States Army to serve as Director of the Military Academy of the National Guard of Nicaragua. I have taken note of the information which you furnish under instructions from your Government that, circumstances having made it impracticable for final action to be taken, in accordance with Article 4 of the Agreement of May 22, 1941, prior to the termination of the period specified in Article 3 of the Agreement, it is the desire and understanding of your Government, in accord with the con- versations which have taken place in regard to this matter, that the Agreement of May 22, 1941 shall be and is considered to have con- tinued in force on and after May 22, 1943, notwithstanding the provisions of Article 4 of that Agreement. It is likewise the desire of, and it is proposed by, your Government that the Agreement of May 22, 1941, continue in force for a further period of two years commencing May 22, 1943, with the understanding, however, that the provisions of Articles 5 and 6 thereof with respect to methods of termination or cancellation shall be applicable. I have the honor to inform you that the Government of the United States of America is in agreement with the understanding and proposal mentioned above.
