It is not intended, however, that this provision will necessitate adjustment in the case of a minor excess or deficiency, which is to be expected in dealing with estimates of this magnitude. We have taken note of the items listed in the "French Purchasing Program of United States Army Surplus" submitted to the Foreign Liquidation Commissioner by the French Council of Allied Surplus on May 7, 1946, and subsequently amended, (Schedule "D"). To the extent that these items are not transferred under the Agreement, the Foreign Liquidation Commissioner will use his best efforts to make such items available from surplus stocks in other parts of the world. These items will be made available at 20% of original cost. The Foreign Liquidation Commissioner will also use his best efforts to arrange for the transportation of such property to France, the cost thereof to be borne by the French Government. It is also the intention of the Foreign Liquidation Commissioner to make available to the French Government such of its requirements for locomotives and rolling stoc, as may be available from surplus property and as may be allocated to France by the ECITO. These sales are not, however, covered by the understanding set forth in the pre- ceding paragraph for the sale of certain items at 20% of original cost. The Memorandum of Agreement provides for the termination of Ant, p .4179. sales as of noon, Paris time, May 25, 1946. For your convenience, we will be glad to request Mr. Virden to communicate to the Conseil des Surplus information as to the property covered by contracts or commitments prior to that time.
