(d) The Secretary of the Treasury shall be the trustee of the Trustee. Cooperative Fund. It shall be the duty of the Secretary of the investments. Treasury to invest such portion of the Fund as is not, in his judgment, required to meet current withdrawals. Such investments shall be in public debt securities with maturities suitable for the needs of such Fund and bearing interest at rates determined by the Secretary of the Treasury, taking into consideration current market yields on outstanding marketable obligations of the United States of comparable maturities. (e) If, before the date three years after the date of the enactment Termination. of this title— (1) the waiver and release referred to in section 307 does not take effect by reason of section 307(d); or (2) the suit referred to in section 307(a)(1)(C) is not finally dismissed the Cooperative Fund under this section shall be terminated and the Secretary of the Treasury shall return all amounts contributed to the Fund (together with a ratable share of accrued interest) to the respective contributors. Upon such termination, the share contributed by the United States under subsection (b)(3) shall be deposited in the General Fund of the Treasury. (f) Payments for damages arising under 304(c) and 305(d) shall not exceed in any given year the amounts available for expenditure in any given year from the Cooperative Fund established under this section. SEC. 314. No authority under this title to enter into contracts or to make payments shall be effective except to the extent and in such amounts as provided in advance in appropriations Acts. SEC. 315. This title may be cited as the "Southern Arizona Water Rights Settlement Act of 1982". Approved October 12, 1982.
