PUBLIC LAW 98-94—SEPT. 24, 1983 97 STAT. 657 10 USC 2107, 2107a. 10 USC 2005 note. clauses (1) through (4) of such subsection, any agreement required by this subsection shall provide— "(1) that if such person fails to complete the education re- quirements specified in the agreement, the Secretary will have the option to order such person to reimburse the United States in the manner provided for in clause (3) of such subsection without the Secretary first ordering such person to active duty as provided for under clause (2) of such subsection and sections 2107(f) and 2107a(f) of this title; and "(2) that any amount owed by such person to the United Stat^ under such agreement shall bear interest at the rate equal to the highest rate being paid by the United States on the day on which the reimbursement is determined to be due for securities having maturities of ninety days or less and shall accrue from the day on which the member is first notified of the amount due to the United States as a reimbursement under this section. ". (2) The amendment made by paragraph (1) shall apply with respect to agreements entered into after September 30, 1983. (c)(1) Section 2107(b)(5) of title 10, United States Code, is amended— (A) by striking out "either" in the matter preceding subpara- graph (A)(ii); (B) by striking out "or" at the end of subparagraph (A); (C) by striking out the period at the end and inserting in lieu thereof "; or"; and (D) by adding at the end the following: "(C)(i) accept an appointment, if offered, as a commissioned officer in the Army, Navy, Air Force, or Marine Corps, as the case may be; and "(ii) serve in a reserve component of that armed force until the sixth anniversary of the receipt of such appointment, unless such appointment is otherwise extended by subsection (d) of section 2108 of this title, under such terms and conditions as lo usc 2108 may be prescribed by the Secretary of the military department concerned.". (2) The second sentence of section 2107(b) of such title is (A) by inserting "or (5)(C)" after "(5)(B)"; and (B) by striking out the period at the end and inserting in lieu thereof ", except that performance of service under clause (5)(C) shall include not less than two years of active duty.". (3) The amendments made by this subsection shall apply with respect to agreements entered into under section 2107(b)(5) of title 10, United States Code, after September 30, 1983. 10 USC 2107 note.
