the Kingdom of Thailand (Interim)

Given on the 5th day of December 2489 BE
Being the 2nd year of the present reign

Whereas it is appropriate to amend the transitory provisions of the Constitution of the Kingdom of Thailand (Interim) dated 9 November 2490 Buddhist Era, so that elections of Members of the Chamber of Deputies in the initial period would proceed in a proper manner;

Therefore, with the approval of the National Assembly, the Monarch gives a Great Royal Command that the following Amendment to the Constitution be enacted:

Section1.This Constitution is called the Amendment of 2490 BE to the Constitution of the Kingdom of Thailand (Interim).

Section2.This Constitution shall enter into operation from the day following the day of its publication in the Royal Gazette onwards.

Section3.The dispositions of section 97 of the Constitution of the Kingdom of Thailand (Interim) dated 9 November 2490 Buddhist Era shall be repealed and replaced by the following dispositions:

Section97.In the initial period, elections of Members of the Chamber of Deputies shall be conducted using the numeric rule of one Member of the Chamber of Deputies per two hundred thousand inhabitants according to the latest census. If the number of the inhabitants in any province is less than two hundred thousand, one Member of the Chamber of Deputies shall be elected in that province. If the number of the inhabitants in any province exceeds two hundred thousand, one additional Member of the Chamber of Deputies shall be elected in that province per every two hundred thousand inhabitants. The residue of two hundred thousand shall, if reaching or exceeding one hundred thousand, be counted as two hundred thousand. In addition, the method of combination of provincial areas shall be used as a procedure for the elections.

In conducting elections in this initial period, the provisions of the Amendment (No 3) of 2479 Buddhist Era to the Elections Act, 2475 BE, and the later amendments, shall apply. However, the age of the electoral candidates according to the disposition of section 16(1) of the Amendment (No 3) of 2479 Buddhist Era to the Elections Act, 2475 BE, is hereby designated to be not less than full thirty-five years, and the prohibition according to the disposition of section 17(1) of such Act shall also be excluded.

Once an election has been held in the initial period, if a membership in the Chamber of Deputies falls vacant for any other reason than retirement upon expiry of the Chamber or dissolution of the Chamber, and a replacing Member has to be elected, then the provisions of the previous paragraph shall apply.”
