Order of the National Administrative Reform Council
No 1

In order to maintain peace, order, and safety for the people throughout the Country, the Order of the National Administrative Reform Council hereby imposes the martial law throughout the Kingdom from the 6th day of October 2519, the time of 19:10 hours, onwards, and orders the following to be followed:

Article1.All the cases involving the charges against the offences under the Criminal Code which are listed in the Schedule hereto annexed and which take place on or after the 6th day of October 2519, the time of 19:10 hours, shall be subject to the trial and adjudication power of the military courts, save where they need to be addressed before a child and juvenile court.

Article2.The Criminal Court and all the provincial courts within the area of the First Army Circle, as well as all the provincial courts within the area of the Lop Buri Army Province, shall become the military courts of Krung Thep. As regards the other provincial courts than the aforesaid, they shall also become the military courts of the army circle within the area of which they are located.

In the aforesaid military courts, three justices shall constitute a quorum competent to try and adjudicate upon cases and to execute judgments.

Article3.The Chief Judge of the Criminal Court, judges of the Criminal Court, and judges of all the provincial courts shall also become military court justices under the law on military court constitution when their courts constitute military courts according to article 2.

The regional chief judges shall become military court justices in the same manner as the aforesaid judges and shall have the power to sit for trying and adjudicating cases at the courts within their territories when they constitute military courts according to this Announcement, and shall also have the power to sign judgments upon having examined the files of any cases.

The registrar of the Criminal Court and the registrars of all the provincial courts shall also become the registrars of those military courts.

Article4.The public prosecutors shall also become judge advocates.

Article5.The office of the Criminal Court and the offices of all the provincial courts shall also serve as the offices of the military courts under this Announcement.

Article6.All the cases taking place before the entry into operation of this Announcement shall be governed by the laws and the martial law announcements in operation at that time.

Article7.Upon announcement of lifting the martial law, the military courts under this Announcement shall remain empowered to try and adjudicate upon the cases under article 1 which are pending before them and in which the offences have taken place before the date and time of lifting the martial law.

(1)Offences against the King, Queen, Heir to the Throne, and Regent, from sections 107 to 112.

(2)Offences against the internal and external security of the State, from sections 113 to 129.

(3)Offences against the friendly relations with foreign countries, from sections 130 to 135.

(4)Offences related to public tranquillity: offence of forming a secret society, offence of forming a criminal association, and offence of gathering or assembling and exercising forcible violence, threatening to commit violence, or causing civil disorder, from sections 209 to 216.

(5)Offences related to the causing of danger to the public, from sections 217 to 239.

(6)Offences related to sexuality: offences of recruiting or luring a woman or girl for indecent purposes or for fulfilling the sexual desire of another, from sections 282 to 284, as well as 285 only when related to sections 282 and 283.

(7)Offences against life, from sections 288 to 294.

(8)Offences against body, from sections 295 to 300.

(9)Offences related to property: offences of theft, offences of snatching, offences of extortion, offences of blackmailing, offences of robbery, offences of gang robbery, and offences of receipt of stolen goods, from sections 334 to 340 bis, 357, and 360 bis.
