Penal Code Amendment

2474 Buddhist Era

His Majesty King Maha Prajadhipok Phra Pokklao Chaoyuhua bestows upon all heads a Great Royal Command that it be announced for general information as follows:

Whereas He is of the opinion that it is appropriate to modify the provisions of certain sections of the Penal Code;

Therefore, He is graciously pleased to enact an Act containing the following sections:

Section1.This Act shall be called the Penal Code Amendment Act, 2474 Buddhist Era.

Section2.This Act shall enter into operation from the day of its publication in the Royal Gazette onwards.

Section3.The provisions of section 241 of the Penal Code shall be repealed and replaced by the following dispositions:

“Section241.Whoever, in order to satisfy the lust of another person, dares procure, lure away, or lead away for an indecent purpose a woman or girl who is younger than eighteen years of age, even with the consent of such woman or girl, shall, Lord says, be culpable and be punished with imprisonment of not over three years and a fine of not over two thousand baht, regardless of whether or not the acts constituting his offence are committed in different countries.
Whoever, in order to satisfy the lust of another person, dares exercise a deceitful trick, physical force, threat, undue influence, or other forcible means to procure, lure away, or lead away a woman or girl for an indecent purpose shall, Lord says, be culpable and be punished with imprisonment of not over five years and a fine of not over three thousand baht, regardless of whether or not the acts constituting his offence are committed in different countries.”

Section4.The phrase “twelve years” in sections 244, 245, and 246 of the Penal Code shall be amended to be “thirteen years”.

Section5.The phrase “older than twelve years of age” in section 248 of the Penal Code shall be taken out.

Section6.The phrase “fourteen years” in sections 274 and 275 of the Penal Code shall be amended to be "eighteen years".

Announced on the 14th day of April 2474 Buddhist Era, being the 7th year of the present reign.
