Paragraph 1- If one leases a field from another for 10 kur of wheat and the wheat was blighted, he would pay the lease from the wheat in the field. If the wheat was nice, the lessee may not say he will buy wheat from the market. Rather, he gives wheat from the field. When is this true? Where the lessee did not deviate. If he deviated, however, such as where he made a condition to plant wheat and give barley for the lease, and he planted barley which was blighted, he cannot give from the barley of the field. Rather, he would buy barley from the market. If he leased a vineyard for 10 baskets of grapes and their taste was ruined after they harvested, or sheaves that were blighted after he harvested them, the lessee would give from the field. If he leased for 10 jugs of wine, which went sour, however, he is required to give the owner good wine.
