Copyright status

Based on this copyright discussion, the translation is presumed to be the copyright of the anonymous contributor who posted this to English Wikipedia (see linked discussion for details) and licensed under the standard contribution licenses (CC BY-SA 3.0 + GFDL) for Wikimedia projects.

The original Russian, however, hinges on the biographical details of the author, which are not currently known. If we assume that Gusev was from Russia (so that modern Russian copyright law is the relevant Soviet successor state law), then the original's copyright has expired in Russia. If Gusev was not from Russia then the copyright law of a different Soviet successor state applies.

There is also an open question about the original's copyright status in the US due to the URAA. The URAA date for Russia is 1 January 1996, and the copyright law in effect in Russia on that date is the 1993 copyright act as amended in 1995 (presumably emended in connection with joining the Berne convention). Under the current copyright act this work was not in the public domain on the URAA date and its US copyright would have been set to publication date plus 95 years (1933+95=2028), but what terms applied under the 1993 act I have not been able to determine so it is possible its copyright was expired under the 1993 act and restored by the 2006 act.

Note that Russian copyright law has special provisions for those who worked during or participated in WWII (+4 years of protection), and for author's who were suppressed and later posthumously rehabilitated (term runs from date of rehabilitation instead of date of death). @Dmitrismirnov, @Charles Matthews: Any chance you're able to dig up some biographical details on Gusev? In particular which Soviet federated republic he was born in, where he lived and worked (likely place of publication for the lyrics in question), and whether or not he participated in the war (likely: he died at 35 years old in 1944, and is famous for writing a military song). If he was Russian, any information about the terms of the 1993/1995 copyright act (if different from the 2006 act) would also be useful. --Xover (talk) 07:36, 7 September 2019 (UTC)

@Xover: Born in Moscow.[1] ru:w:Гусев, Виктор Михайлович (поэт) says he was an administrator for radio, so probably not a combatant in WWII. In Moscow for a Shostakovich premiere in 1943.[2] Charles Matthews (talk)
