Executive Order 1364

It is hereby ordered that the military reservation of Torrey Barracks, at Malabang, in the Island of Mindanao, Philippine Islands, made by Executive Order dated May 29, 1903, as amended by order of December 22, 1904 (G. O. 193, War Department, December 22, 1904), and reduced by Executive Order of July 21, 1906 (G. O. 138, War Department, July 30, 1906), be enlarged by reserving, subject to private rights, if any there be, and to the conditions hereinafter set forth, additional lands, so that the reservation, as thus enlarged, will include all lands, except the town site of Malabang hereinafter described, within metes and bounds as follows:


Beginning at a point on the north bank of the Malabang River, at its entrance to Illana Bay, said point being 129.5 meters due south from monument No. 7, marking corner No. 6 of the town site of Malabang; thence true north 5,762.25 meters to monument marking the northwest corner of the reservation; thence true east 3,218.69 meters to a monument marking the northeast corner of the reservation; thence true south 6,437.38 meters to a monument at angle in east boundary of the reservation; thence S. 30° 00′ W. 1,676.42 meters to a monument on east boundary of the reservation; thence continuing S. 30° 00′ W. 15.25 meters, more or less, to the shore of Illana Bay; thence in a northwesterly direction, following the shore of Illana Bay to the point or place of beginning. Containing an area (exclusive of said town site) of approximately 2,148.36 hectares. All bearings are true.


The following-described premises are excluded from the above reservation; the same being the town site of Malabang:


Beginning at a monument, marked No. 7 and corner No. 6 of the town site of Malabang, as published in Executive Order No. 117—1908, E. B., P. I., said monument being on the west boundary of, and 129.50 meters due north of the southwest corner of the military reservation of Torrey Barracks; thence true north 1001.40 meters along the west boundary of the military reservation to a monument at corner No. 7 of the town site; thence S. 45° E. 1,307.40 meters to a monument at corner No. 8 of the town site; thence N. 45° E. 132.70 meters to a monument at corner No. 9 of the town site; thence S. 79° 59′ E. 535.10 meters to a monument, on the north bank of the Malabang River, at corner No. 1 of the town site; thence true south 1,056.10 meters to a monument, at corner No. 2 of the town site; thence true west 365.60 meters to a monument, at corner No. 3 of the town site; thence N. 45° W. 406.90 meters to the bank of the Malabang River at corner No. 4 of the town site; thence true west 201.20 meters to a monument, at corner No. 5 of the town site; thence N. 45° W. 976.60 meters to the point or place of beginning. Containing an area of 155.07 hectares. All bearings are true. The above excluded premises lie entirely within the military reservation of Torrey Barracks.


The said reservation is made subject to the following conditions:


That no private property shall be taken or destroyed without first making payment therefor; that no private parties who are at present lawful owners or occupants or in the lawful possession or occupation of the lands required for this reservation, shall be dispossessed or disturbed in their ownership, possession or occupation, until their ownership or right to possession or occupancy has been extinguished by due process of law, and all lawful claims of such owners or occupants have been fully paid.
