ORDER IN COUNCIL extending the duration of the Dominica Legislative Council—London, February 22, 1940([1])

At the Court at Buckingham Palace, the 22nd day of February, 1940

PRESENT: THE KING’S MOST EXCELLENT MAJESTY IN COUNCIL

WHEREAS it is provided by section 33 of “The Dominica Order in Council, 1939,”([2]) that the Governor of the Windward Islands shall dissolve the Legislative Council of Dominica (hereinafter referred to as “the Council”) at the expiration of 3 years from the date of the return of the first writs at the last preceding general election, if it shall not have been sooner dissolved :

And whereas by virtue of sub-section (4) of section 1 of “The Dominica Act, 1938,([3]) the said Order may be varied by a subsequent Order in Council:

Now, therefore, His Majesty by virtue and in exercise of the powers conferred on him by the said Act and of all other powers enabling him in that behalf, is pleased by and with the advice of his Privy Council to order, and it is hereby ordered, is follows : —

1. This Order may be cited as “The Dominica (Legislative Council—Extension of Duration) Order in Council, 1940.”

2. Section 33 of “ The Dominica Order in Council, 1939,” “all have no effect from the date of this Order until the Council last appointed and elected before that date shall have teen dissolved by virtue of the power contained in section 32 of the said Order and a fresh Council shall have been appointed and elected.
