Where the Wife fhall be endowable of Lands recovered againft her "Hufband, Where the Heir may avoid a Dower recovered. A Remedy for particular Tenants lofing by Default. N cafe where the Hufband, being impleaded for Land, giveth up the Land demanded unto his Ad- verfary fey Covin ; after the Death of the Hufband, the Juftices fhall award the Wife her Dower, if it be demanded by Writ. (2) But in cafe where the Huf- band lofeth the Land in demand by Default, if the Wife, after the; Death of her Hufband, demandeth her Dower, it hath been proved, ; that fome Juftices have awarded unto the Woman; her Dower notwith- ftanding the Default' which her Hufband made, other Juftices being of the contrary Opinion, -and judging otherwife. To the intent that from 1 henceforth fuch Ambiguity fhall be taken away, it is thus ordained in certain, That in both Cafes the Woman demanding her Dower fhall be heard. (3) And if it be al- ledged againft her, that her Hufband loft the Land, whereof the Dower is demanded by Judgement, whereby fhe ought not to have Dower, and then it be inquired by what Judgement, and it be found that it was by Default, whereunto the Tenant muft an- fwer ; then it behoveth the Tenant to anfwer further, and to fhew that he had Right, and hath in the fore- said Land, according to the Form of the Writ that the Tenant before purchafed againft the Hufband. (4) And if he can fhew that the Hufband of fuch Wife had no Right in the Lands, nor any other but he that holdeth them, the Tenant fhall go quit, and the Wife fhall recover nothing of her DoWer; which Thing if he cannot fhew, the Wife fhall recover her Dower. (5) And fo in thefe Cafes, and in certain other following, that is to fay, When the Wife being endowed lofeth her Dower by Default, and Tenants in free Marriage, by the Law of England, or for Term of Life, or in Feetail, divers Actions do con- cur for fuch Tenants, when they muft demand their Land loft by Default : (6) And when it is come to that Point, that the Tenants muft be compelled to fhew their Plight, they cannot make anfwer without them to whom the Reverfion of Right belongeth ; therefore it is granted unto them tovouch to Warranty, as if they were Tenants, if they have a Warranty.
