Defeflive Stuffs paid fo^ the fame; (4) and if upon Search and View thereof, any fuch Stuffs fliall be found and appear tc» jhai i^e foiled ^^ defective, contrary to the Rules and Ordinances of the faid Wardens and Afliftants ; then all luch de- jurv' ^ * fedive Stufl's (hall be feized by the faid Wardens or any Two of them, and tried by a Jury of twelve Ar- tificers of the faid Regulation of Worfted-weavers, Six whereof to be of the City of M^rwic-^, and Six to be of the County of Norfolk, who ihall be from Time to Time impanelled by a Precept under the Hand and Seal of the Mayor ot the City of Nonvich for the Time being or his Deputy ; (5 ) and if any who fliafl be fo impanelled (hall fail in Appearance, ihe Number to be made up either of the Mafter- Weavers of the City of Norwich or of the County of Norfolk, by a Precept (irom the faid Mayor ; (6) which Jury fo im- panelled or taken and (worn before the Mayor of the faid C.ty for the Time being, mall try the faid Stuffs, and find whether they be made according to this Adl and the By-laws and Ordinances made by Virtue thereof or of any other Act of Parliament ; (7) and Ihall have Power to impofe a moderate Fine according to the Nature ot the Offence, not exceeding the Moiety of the Value of the defe<ftive Stuffs fo feized and tried, the fame Fines to go to the Ufe of the Trade and Manufadure ; (8) and thofe Stuffs which (hall be found defedive to be detained until the Fine or Fines fet upon them by the Jury be paid ; (9 ) which if the Owner of the fame Stuffs (liall not pay to the faid Wardens or fome of them, within forl;y Days after the Trial, then the fame Stu(Fs to be fold by any Two of the faid Wardens, and the Overplus of the Monies thereof coming after the Fines deducted to be reflored to the Owner upon Demand. The Penalty for XI. And it is further enadled, That if any Warden or Wardens (hall at any Time feal, or caufe to be feaiing defeaive fealed, any Stuffs made under the faid Regulation which (hall afterwards be difcovered by any Perfon to be Stuffs. defeiftive, contrary to this prefent A6t and the By-laws, Rules and Ordinances thereupon made or here- after to be made, or any of them, and found fo to be by a Jury of twelve Artificers of the faid Trade,- from Time to Time to be impanelled and fworn before the laid Mayor or his Deputy, and the faid Steward of the Duchy oi Lancajler for the Time being if he be there prefent, and if the faid Steward be ablent, then before the faid Mayor or his Deputy only, of which Jury Six (liall be of tlie faid City Wea- vers, and the other Six of the (aid Country Weavers, who (liall have and hereby have Power to fet and ■impofe a Fine upon the Warden or Wardens of the faid Trade offending, for every Piece of defecflive Stuff fo fealed, as the fame Jury in their Difcretions (hall think fit ; the fame Fine not exceeding the Sum of forty Shillings, which (fiall be to the Ufe of the King's Majefty; (2) and that the fame Jury or any other fuch like Jury from Time to Time to be impanelled by and fworn before the Perfons aforefaid, or any of them, (hall likewife enquire into all and every other the Frauds, Abufes and Mifcarriages of the Wardens and Affiftants and every of them, in the Execution of their OfRces, and correft and punifli them and every of them for their feveral Offences, in fuch Manner as is herein before-mentioned to be done againft any other Offenders who are under the faid Regulation. Perfons unjuiiiy XII. Provided, That if the faid Wardens or any of them (hall be unjuftly molefted, and that if fuch moieijed to have Stuffs upon Trial fhall be found by the Jury to be good and duly made, or that they or the Affiftants, or 4oubleDamages. ^^y of them, are not guilty of any fuch Frauds, Mifcarriages or Abufes, as they are complained of for, the Perfon or Perfons (0 caufelelly molefting (hall pay to the Wardens or AflKfants or any of them fo un- juftly molefted, double the Damages they or any of them (liall or may fufta!n by any fuch Moleftation. None may buy XIII. And be it further enacted by the Authority aforefaid, That it (liall not be lawful for any Perfon S'uffsunfeaied. or Perfons to buy any Piece or Pieces of Stuffs before the fame be fealed by the Wardens of the faid Saving for 'he Trade : Saving to the King's Maje(fy, his Heirs and Succeffors, all fuch Right of Cuftoms, Subfidies and injjs u nage. y^^jj^^gg Qf Norfolk and Norwlb Stuffs or Worfteds or any of them, as he or they might lawfully have claimed before the Making of this Adt : (2) And tliat if any Piece or Pieces of Stuffs (hall be found in the Poffelfion of any Perfon or Peifons unfealed, except in the Poffelfion of the (irft Owner or Maker thereof, the Perfon or Perfons in whofe Cuftody the fame (haU be found, (hall be adjudged guilty of De-- ceit, and (hall forfeit for every fuch Piece of Stuff which be fo found in his or their Pofleffion unfealed as The Penalty for aforefaid, the Sum of four Shillings ; (3 ) and the Maker and Seller of the fame who fhall deliver the fame biiyios unfcaled out of his or their Poftellion before the fame be fealed, (hall likewife forfeit for every fiich Piece, other Stuffs. £(jyf Sliillings, to the Ufe of the Poor of the faid Trade and Manufacture.
