HEREAS an Aft m.ade in the eighteenth Year of his Majefty 's Reign that now is, intituled, An' J V » Aui for Burying in IVoollen only, was intended for the lefTening the Importation of Linen from be- j yond the Seas, and the Encouragement of the Woollen and Paper Manufaftures of this Kingdom, had ^ the fame been obferv^d ; {^) but in refpecl there was not a fufficient Remedy thereby given for the Dif-. ^ covcry and Profecution of Offences againft the faid Law, the fame hath hitherto not had the EfFeft there- by intended :' " n. For Remedy whereof. Be it enafted by the King's mofl: Excellent Majefty, by and wiih the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the faid Aft, and all the Claufes and Provifoes therein, (hall be and are hereby annulled and rcpealcJ, to all Intents, Conftruftions and Purpofes whatfoever. . III. And it is hereby enafted by the Authority aforefaid. That from and after the firft 'Dt.y of Augtifi one- thoufand fix hundred and feventy-eight, no Corps of any Perfon or I'erfons fliall be buried in any Shirt, Shift, Sheet or Shroud, or any Thing whatfoever made or mingled with Flax, Hemp, Silic, Hair, Gold or Silver, or in any Stuff or Thing, other than what is made of Shecjis Wool only, or be put in any Coffiri< lined or faced with any fort of Cloth or Stuif, or any other Thing v/hatfoever, that is made of any Rlate- rial but Sbeeps Wool only : (2) upon Pain of the Forfeiture of five Pounds of lav/ful Money of England, to be recovered and divided as is hereafter in this Aft exprefTcd and direfted. ■■IV. And it is enafted by the Authority aforefaid. That all Perfons in Holy Orders, Deans, Parfohs, Deacons, Vicars, Curates and their or any of their Subftitutes, do v/ithin their refpeftive Parifhes, Pre- cinfts and Places, take an exaft Account, and keep a Regiftcr, of all and e'ery Perfon or Perfons buried in his or their refpedlive Parifhes or Precincls, or in fuch comm.oii Burial-places as their refpeftive Parifhioners are nfually buried ; (z) and that fome one or more of the Relations of the Party decea'"i:d, or other cre- dible Perfon, fhall within eight Days next after fuch Interm.ent, bring an Affidavit in Writing under the Hands and Seals of two or more ciedible Witneffcs, and under the Hand of the Magiftrate or OfRcer be- fore whom the fame was fworn (for which nothing fhall be paid) to the Minifi:er or Parfon, That the fri'd Perfon was not put in^ wrapt or vi'ound up, or buried in any Shirt, Shift, She t or Shroud, made or min- gled with Flax, Hemp, Silk, Hair, Gold or Silver, or other than what is made of Sheeps Wool only, t r in any CofHn lined or faced with any Cloth, Stuft" or any other Thing v/hatfoever, made or mingled with Flax, Hemp, Silk, Hair, Gold or Silver, or any other Material but S'neeps Wool only ; (3) and if no P.e- lation -of the Party buried, or other Perfon, fnall bring an y^7tte'/V as afoi'cfaid, to the Parfon or Mini ;Ier, within the Time aforefaid. That then the Goods and Chattels of the Party deceafed fliall be and are hereby m.ade liable to the aforefaid Forfeiture of five Pounds ; (4.) to be levied by vay of Diftr'-fs and Sale therco*", by Warrant of the Chief Magiftrate in any Town Corporate, or any juftice of the Peace, or in Default (hereof, by bke Diflrefs and Sale of the Goods of the Ptrfon in whofe I-ljuf-' the faid P;;r'y died, O" o*" any that had a H.;nd in putting fuch Perfon into any Shirt, Slii^'t, Sheet, Shroud or Coffin, contrary to this A'% or did order or dil'pofe the Doing thereof; (;) and in Cafe fuch Perfon were a Servant, and that he or flie dictl in the Family of his or her Mafter or Miftrefs, That the fame be levied on the Goods or Chattels of his or her Mafter or Miftr^ fs ; (6) and if fiich Perfon died in the Family of his or her Father or Mother, Th-t then the fame be levied upon the Goods ami Chattels of his or her Father or IVTother, in Manner and by Warrant as aforefaid ; (y) Which faid Forfeiture or Forfeitures flrall be levied, paid and allowed out of the Eftate of the faid deceaied Perfon, before any Statute, Ju gment, Debt, Legacy, or any other Duty whatfoever, due, owing or payable from the faid Deceafed, , , V. And it is hereby further enafted.
