And be it further enacted by the Authority aforefaid, That after the Seizure and Condemnation ■AOerScizurr mS )f fuch Ship, Veffel or Boat, the Principal Officers of his Majefty's Cuftoms in the Port or Place where S ^ Ts n - he fame fhall be at the Time of fuch Condemnation, are hereby directed to caufe the Hull of fuch bc u bur ° n ' t anj'the Ship, Veffel or Boat to be burnt and wholly deftroyed, and the Tackle, Furniture and Apparel there- Tackle, &c. fuM. into belonging, to be publickly fold to the beft Advantage, and the Produce thereof to be divided as icrein after mentioned, the reafonable Charges of profecuting, felling and burning as aforefaid being firft deducted. ' III. And whereas many Frauds are committed to the Prejudice of the Revenue in the clandeftine ' Running of Goods imported, and in relanding Certificate Goods, as well as in exporting Wool and the ' Coin of this Kingdom, by Watermen and others in Boats, Wherries, Pinnaces, Barges and Gallics, ' which are fomctimes rowed with fix, eight or twelve Oars, built on Purpofe for the Smuggling Trade ; ' and in cafe they are purfued by the Officers, do make their Efcape, which may be alfo a Means of bring- ' ing in the Infection :' For the preventing whereof, Be it further enacled by the Authority aforefaid, That Boats, Sec. row- from and after the faid twenty-fifth Day of March one thoufand feven hundred and twenty-two, if any Boat, ,n t with more Wherry, Pinnace, Barge or Galley, rowing or made or built to row with more than four Oars, fhall be '?"" ,our °" s « , found upon the Water or in any Bargehoufe, Workhoufe, Shed or other Place within any of the Counties Londnn Bridge of Middlefex, Surry, Kent or Effex, or in the River of Thames, either above or below London- Bridge, or &c. forfeiced. within the Limits of the Ports of London, Sandwich or Ipfzvich, or the Members or Creeks to them or ei- ther of them refpeflively belonging, fuch Boat, Wherry, Pinnace, Barge or Galley, with all her Tackle and Furniture, or the Value thereof, fhall be forfeited, and fhall and may be feized by any Officer or Of- ficers of the Cuftoms ; and the Owner or Owners thereof, or any Perfon ufing or rowing in fuch Boat, Owner, & c . to Wherry, Pinnace, Barge or Galley, fhall alfo forfeit and lofe the Sum of forty Pounds; and fuch Seizure or el 4 ° and Forfeiture fhall and may be profecuted in the Manner herein after-mentioned ; and after the Seizure "oat, &c. after and Condemnation of fuch Boat, Wherry, Pinnace, Barge or Galley, the principal Officers of his Ma- Condemnation, jefty's Cuftoms in the Port or Place where the fame fhall be at the Time of fuch Condemnation, are here- xheVefleis' con- by directed to caufe fuch Boat, Wherry, Pinnace, Barge or Galley to be burnt and wholly deftroyed, demnedmaybe and the Tackle, Furniture and Apparel thereunto belonging to be publickly fold to the beft Advantage, ufed, &c. by the Produce whereof to be divided as herein after mentioned ; the reafonable Charges of profecuting, fel- 12 Geo. i. c. a?, ling, and burning as aforefaid being firft deducted. ka ' 14- IV. Provided always, That this Act fhall not extend or be conftrued to extend to any Barge or Galley To what Barges, ' belonging to or to belong to' his Majefty, or the Royal Family, or any of them, or to any Long-Boat, &c lhls AcT; fhall Yaul, or Pinnace belonging to and ufed in the Service of any Merchant-Ship or Veffel, or to fuch Boat, noc exten • Wherry, Pinnace, Barge or Galley, as fhall be licenfed by the Lord High Admiral, or Commiffioners for executing the Office of Lord High Admiral, or the Major Part of the fame Commiffioners for the Time being ; which Licences fhall be in Writing, figned by the faid Lord High Admiral, or Commiffioners for Licences to be executing the Office of Lord High Admiral, or the major Part of fuch Commiffioners for the Time being, figned by the and fhall be granted without any Fee or Charge whatfoever. Admiralcy. V. Provided always. And be it further enacted by the Authority aforefaid, That from and after the faid twenty-fifth Day Perfons pairing of March one thoufand feven hundred and twenty-two all and every Perfon and Perfons, who fhall be found wuil foreign paffing (knowingly and willingly) with any foreign. Goods or Commodities landed from any Ship or Go ° ds la " de ' 1 Veffel, without the due Entry and Payment of the Duties by Law charged thereon, in his, her or their JJjJ being more Cuftody, from any of the Coafts of this Kingdom, or within the Space of twenty Miles of any of the faid than five, and Coafts, and fhall be more than five Perfons in Company, or fhall carry any Offenfive Arms or Wea- refilling Officers, pons, or wear any Vizard, Mafli or other Difguife, when paffing with fuch Goods or Commodities as &c - to be »anf- aforefaid, or fhall forcibly hinder or refill: any of the Officers of the Cuftoms or Excife in the feizing or ? oned - fecuring any Sorts or Kinds of run Goods or Commodities, fhall be deemed and taken to be Runners of foreign Goods and Commodities within the Meaning of this prefent AcT:, and (being convicted of or for any of the faid Offences, for which he, fhe or they fo convicted are by this prefent AcT: declared to be deemed and taken to be Runners of foreign Goods and Commodities) fhall be adjudged guilty of Felony,. and fhall, for fuch his, her or their Offence, be trnfported as a Felon to fome or one of his Majefty's Colonies or Plantations in America, there to remain for the Space of feven Years, in the fame Manner as Felons are appointed to be tranfported by an Aft made in the fourth Year of his Majefty's Reign, intitu- 4 Geo. 1. c. iu led, An Aft fcr the preventing of Robbery, Burglary and other Felonies ; and for the more ejfeStual Tranfporta- tion of Felons and unlawful Exporters of I Fool; and for declaring the Law in fame Points again/l Piracies ; and by another Act made in the fixth Year of his Majefty's Reign, intituled, An Ail for toe further preventing 6 Geo. r. c. 23. Robbery and Burglary and other Felonies ; and for the more ejfeclual Transportation of Felons ; and if any fuch t. .
