C. 14.. 441 the fame Means and Methods, and by and under fuch Rule:; and Directions, and under the f.ime Penal- ties and Forfeitures and Powers, as are prefcribed, mentioned and exurefled in the Acts of PartUdient aforefaid ; and that both the faid Aft made in the Parliament of Scotland, and the Aft made in the third , Geo. i.e. 5. Year of his Majefty's Reign, and every Article, Rule, Claufe, Matter and Thing therein contained, fhall be of full Force and Effeft to all Intents and Purpofes, as if the fame were particularly and at large exprcfTcd, repeated and re-enafted in the Body of this prefent Act, for the more effectual levying and rai- fing Payment of the faid Duty and Duties within the faid City of Edinburgh and Liberties and Suburbs thereof, and within the faid Parifhes of Saint Cuthberts, Canon-Gate, South and North Lcith, for and du- ring the faid new and additional Term of nineteen Years hereby granted, and to and for the feveral Pur- poles and Intents in the faid Afts or either of them particularly mentioned, except in fo far as is hereby altered and varied. III. And be it further enacted by the Authority aforefaid, That what Money fhall be due and payable by Virtue of this Aft, and what fhall arife by the faid Duty during both the faid Terms of thirty-eight Years granted by this and the faid former Aft, fhall be applied, difburfed, laid out and difpofed of, to and for the feveral Ufes, Intents and Purpofes, and in fuch Manner as is herein after declared (the rea- Money pjvablc fonable Charges expended or to be expended in or about, or by Reafon of paffing this Act of Parliament l>y this Aft, how being firft deducted) as the fame fhall be Itated and allowed by the Overfeers after named, or the Majority t0 bca rP"«- of them prefent, at one of their General Meetings under mentioned : And the faid Magiitratcs and Coun- cil of the faid City are hereby impowered and authorized to apply, lay out and difpofe of the fame, to and for the Intents and Purpofes herein after mentioned, videlicet, for distributing the Water brought or to be brought into the faid City, in fuch Way and Manner, as may be moft for the Publick Ufe and Conveniency of the faid City and the Inhabitants thereof, for fupplying the Canon-Gate, South and North Leitb with Water, for finifhing and compleating the faid Harbour or Pier of Leith, for caufeying or lay- ing with Free Stones (in fuch Places where it may be found proper and necefTary) the High Streets, Areas, Courts or Squares, Lanes and By-Streets that are or fhall be within the faid City, with the High- ways and Avenues leading to and from the fame, for repairing the City Walls, for building another of the new Churches direfted by the former Act to be built, for fatisfying the refpeftive annual Payments appointed by the faid recited Aft of Parliament of the third Year of his Majefty's Reign, videlicet, for maintaining and employing the Poor, for Payment of the Ministers Stipends, for Payment of the Sum granted in Aid of the Deficiency of the Town's Revenue, for Payment of the ProfeiTbr of the Civil Law his Salary ; and alfo for and towards Payment of a Sum not exceeding the Sum of five hundred Pounds Sterling annually and every Year, to be applied by the Magiftrates and Council of the faid City, for and towards the Relief of fuch of the poorer Sort of the Inhabitants of the faid City, as are or ought to be taxed for the maintaining and paying of the Guard of the faid City, at or below the Rate of four Pounds Scots each, in fuch Way and Manner, as to the faid Magiftrates and Council fhall feem moft juft and equitable; which faid Sum of five hundred Pounds is hereby enacted to commence, grow due and be payable from and after the firft Day of "July one thoufand feven hundred and twenty-three, and the firft Half-year's Moiety to be payable the firft Day of January thereafter ; and likewife that the faid Duty and Money arifing thereby fhall be applied and laid out, for and towards narrowing the noxious Lake on the North-fide of the faid City commonly called the North Lock, into a Canal of running Water, and making a Communication Street or Way to the Fields and Grounds belonging to the faid City, on the North- fide thereof, and for purchafing fuch Houfes and Grounds, as fhall be by the faid Magiftrates and Coun- cil with the Approbation of the Overfeers judged proper and necefTary to be bought and purchafed for making the faid Street or Communication Way betwixt the faid City and the faid Fields on the North- fide thereof, and likewife for purchafing fuch Houfes and Grounds, as may be thought proper and necef- fary as aforefaid, for making a convenient Area for building the faid new Church, and for building a pro- per Flail or other Conveniencies, for accommodating the Court of Jufticiary, and what Conveniencies may be found necefTary for accommodating the other Courts of Juftice, that meet in the faid City, and the Offices thereunto belonging, a Hall or convenient Place for keeping the Records under the Charge of the Lord Regilter of Scotland, convenient Offices for lodging the Records, Writs, Securities and inltru- ments, which are under the Care of the feveral Clerks of Seffion, the Clerks of Jufticiary, and Commif- fion for Valuation of Tiends, the Clerks of the faid City, the Sheriff and Commilfar Clerks of Edinburgh, the Keepers of the Signet, Chancery, Privy Seal, Great Seal, General Regilter of Safins, General Re- gifter of Hornings and Inhibitions, for Payment of a Sum not exceeding one hundred Pounds yearly, to The Sum of a Profeffor of Univerfal Civil Hiflory, Greek and Roman Antiquities in the faid Univerfity, and for Pay- tool, payable to 'ment of a Sum not exceeding one hundred Pounds yearly, to a Profeitbr of Scots Law, both to commence a ^[°*5 fforc ^ Cl " and grow due from the firft of July one thoufand feven hundred and twenty-three; which two Profeffions ' ory ' c * of Univerfal Civil Hiftory, Greek and Roman Antiquities, and of Scots Law, the Magiftrates and Coun- cil of the faid City are and fhall be authorized and impowered to inftitute and eftablifh, and to nomi- nate and appoint the firft Profeffors, who fhall enjoy the faid Salaries, and be instituted to the whole Privileges and Immunities, that the other Profeffors of the faid Univerfity enjoy and are entitled to. ' IV. And to the End that thefe Profeffions may be in Time coming always fupplied with proper and '* qualified Perfons,' Be it enafted by the Authority aforefaid, That when and fo often as any Vacancies Wh'otofupply fhall happen in any of the faid Profeffions, that the Faculty of Advocates fliall nominate and prefent two Vacancies in the Perfons, whom they fliall judge qualified for fupplying fuch vacant Profeffion, to the faid Magistrates Profeflions. and Council, and that the faid Magiftrates and Council fhall admit and appoint one of the two Perfons -fo nominated and prefented to fupply the Vacancy.
