An A£t for more effectual difarming the Highlands in that Part of Great Britain called Scot- land; and for the better fecuring the Peace and Quiet of that Part of the Kingdom. WHEREAS by an Act made in the firft Year of his Majefty's Reign, intituled, At Aft for the Reciting the more effcilual fecuring the Peace of the Highlands in Scotland, it was enacted, That from and after •" :l ' fJ - *• the firft Day of November which was in the Year of our Lord one thoufand feven hundred and fixteen, Sut> z ' ' ** it fhould not be lawful for any Pcrfon or Perfons (except only fuch Perfons as arc therein mentioned 3 « * 6 Geo. x» and defcribed) within the Shires of Dunbartain on the North-fide of the Water of Liven, Sterling on c ' 2 5* the North-fide of the River of Forth, Perth, Kincairdin, Aberdeen, Invernefs, Nairn, Cromarty, Argyle, Forfar, Bamf, Sutherland, Caithnefs, Elgin and Rofs, to have in his, her or their Cuftody, ufe or bear, Broad Sword or Target, Poynard, Whingar or Durk, Side-Piftol or Side-Piftols, or Gun, or any other warlike Weapons, in the Fields, or in the Way coming or going to, from or at any Church, Market, Fair, Burials', Huntings, Meetings or any other Occafion whatfoever, within the Bounds aforefaid, or to come into the Low Countries armed as aforefaid : And in cafe any of the faid Perfon or Perfons above defcribed fhould have in his Cuftody, ufe or bear Arms, otherwife than in the faid AcT: was directed, every fuch Perfon or Perfons fo offending, being thereof lawfully convicted before one or more Juftices of the Peace, or before any other Judge Competent of the Place fummarily, fhould for the firft Offence forfeit all fuch Arms, and be liable to a Fine not exceeding forty Pounds Sterling, and not under five Pounds Sterling, and to be imprifoned till Payment of the faid Fine ; which if not inftantly paid after Commitment, the faid Fine might and fhould be levied out of the Offender's Goods and Eftate, by Warrant of the Judge, who fhould pronounce any fuch Sentence, to be applied in fuch Manner as by the faid Aft was directed, and the Offender fhould be further liable to a Month's Impri- prifonment ; and being convicted for a fecond Offence before the Court of Judiciary, or before the Judges at their Circuits, fhould forfeit fuch Arms, and be liable to a Fine not exceeding eighty Pounds Sterling, nor under ten Pounds Sterling; and for every fubfequent Offence, to a Fine the Double of the former, to be levied and applied as by the faid Act is directed; and that for the want of Payment of any fuch Fine, or a fufficient Diftrefs to fatisfy the Payment of it, the Offender fhould be liable to- be tranfported to any of his Majefty's Plantations beyond the Seas, there to remain for the Space of feven Years, as by the faid Act, Relation being thereunto had, may at large appear.
