Houfes, who are intitled to the improved Rent thereof; and if. dial! and may be lawful to and for fuch Tenant or Occupier to pay fuch firft Builder or Builders for the fame; as alio for the fhoreing and fupporting the Ploufe as aforefaid, after he or they fhall have built fuch Party-Wall, and to deduct the fame out of the next Rent that fhall become due from him or her to fuch Owner or Owners, under whom he or fhe holds or enjoys the fame, and in cafe of Neglect or Refufal to pay the Expence of building the Party-Wall, or the Expence of fhoreing and fup- porting the Houfes aforefaid, within one and twenty Days after Demand thereof; then it fhall and may be lawful to and for fuch firft Builder or Builders, his, her or their Executors or Adminiftrators, to fue fuch Owner or Owners for fuch their Proportions of the Expences of building or rebuilding fuch foe ft fo^ U thl e p™ a - y Party- Wall, and fhoreing and fupporting fuch Houfe as aforefaid, by Action of Debt, or on the Cafe, portion of the " ^'"' Pl amt or Information, in any of his Majefty's Courts of Record at JVc/lminfter, wherein no EfToin, Expence. And for the better preventing the fpreading of Fires from one Houfe to another, Be it further en- No Door-Cafe, acted by the Authority -aforefaid, That it fhall not be lawful to make or have in any Party- Wall of any Window, &c. to Houfe, which after the twenty-fourth Day oi'June one thoufand feven hundred and twenty-five, fhall be Wll ty " erected or built within the Limits aforefaid, any Door-Cafe, Window, Lentil, Breaft-Summer or Story- Pofts or Plates whatfoever, unlefs where two or more Houfes fhall be laid together, and fo ufed or occu- pied as one Houfe only, and during the Time of fuch Ufage and no longer ; upon Pain that the Owner Penalty 50 1. or Owners of any fuch Houfe lhall for every fuch Offence, forfeit the Sum of fifty Pounds ; but it may be lawful that fuch Door-Cafe, Window, Lentil, Breafi:-Summer or Story-Pofts or Plates fhall or may be fixed or put in the Front of fuch Houfe or Building for the Convenience of a Shop or Shops only. Firft Builder may ' IV. And whereas feveral old Houfes within the Cities of London and IVeftminfter, and other the Li- puii down old ' mits aforefaid, have inftead of one Party-Wall, two old Timber-Walls or Partitions, one belonging to and C 'u ' eac ' 1 Swff, ar *d feparate from one another, and Difputes may arife touching pulling down and rebuild- BrickWall. " ' m & ' Llc Walls or Partitions, as there may be Occafion,' Be it enacted by the Authority aforefaid, That fuch firft Builder as aforefaid, giving three Months Notice as aforefaid, to the Owner or Occupier or Owners or Occupiers, fhall have Power to pull down both the faid Timber- Walls or Partitions, and to build a new Brick Party-Wall of fuch Thicknefs and Height, as is directed by the faid recited Acts, and to pull down and rebuild the fame, and fhall be paid for fuch Party-Walls in fuch Manner, as herein be- fore directed and appointed, fubject to fuch Appeal and Determination by the Juftices of thePeace as aforefaid. Waterfromthe V. And be it further enacted by the Authority aforefaid, That the Water falling from the Tops of the Tops of the faid Houfes to be built after the faid twenty-fourth Day of June one thoufand feven hundred and twenty- Houfes, &c :. to five, within the Limits aforefaid, and the Water falling from the Balconies and Penthoufes thereof, fhall Pany-pYpes. ^ ^ e conve y e d nlt0 the Channels by Party-Pipes on the Sides or Fronts of the faid Houfes, on Pain that Penahy 10 1. ^ e Owner or Owners offending herein fhall for every Offence forfeit the Sum often Pounds. _ VI. And be it further enacted by the Authority aforefaid, That all Fines, Penalties and Forfeitures in- flieted or impofed by this Act, fhall be fued for, levied and recovered in like Manner as is herein before be levied and dif- mentioned, and one Moiety or Half-Part thereof fhall be to the Informer or Informers, and the other pofed of. Moiety thereof to the Poor of the Parifh where fuch Offence fhall be committed. ' VII. And whereas divers Houfes are or may hereafter be built on new Foundations, within the Li- Svcond Builder ' mits above-mentioned, and which ftand fingly by themfelves, and have no Houfe adjoining to one End not to take the ' or Side thereof, by Means whereof fuch Builder or Builders have been at the whole Charge and Ex- Benefit ot the ' pence of building two Party-Walls and a Fence-Wall to one and the fame Houfe, and fome other Per- p rft Bu vvTl' S ' ° r ^ >er '" ons ma y build upon the Ground next adjoining to fuch Houfe or Houfes ;' Be it therefore en- Party- a . a&ed by the Authority aforefaid, That it fhall not be lawful to and for any fuch fecond Builder or Buil- ders, his, her or their Executors, Adminiftrators or AlTigns, to make ufe of or take the Benefit of fuch Party-Wall and Fence-Wall, nor fhall fuch fecond Builder or Builders, his, her or their Executors, Ad- miniftrators or Affigns, on any Account whatfoever, lay any Wood or Timber, or cut any Hole for Cup- Penalty 50I. boards, Preffes, or any otherUies, in fuch Party-Wall, under thePenalty of forfeiting the Sum of fifty Pounds. ' VIII. And whereas by the faid recited Act of the fixth Year of the faid late Queen there is a Penalty ' of fifty Pounds laid upon the Owner and Head Builder or Workman, who fhould neglect to build every ' Houfe thereafter to be built according to the Directions of the faid recited Act, one Moiety whereof to 4 be to the Informer, and the other Moiety to the Poor of the Parifh wherein fuch Buildings fhould be 'erected : And whereas Perfons convicted upon the faid Act, after they have paid the faid Penalty thereby ' inflicted, are not obliged to make good fuch Partition-Walls and Defects, for which they have been ' profecuted, fo that the preventing the Danger that may happen from Fire, which the faid Act was de- ■ ' iigned lor, will in a great Meafure be evaded and rendred ineffectual; and whereas fince the paffing of the faid recited Act, there has been a very great Increafe of Buildings within the Limits aforefaid, and 4 many of the Houfes fo built are not in every refpect built according to the Directions of the faid recited ' Acts, whereby the_ feveral Owners and Head Builders thereof have incurred the faid Penalty, and fe- 5 veral Perfons are informed againft,. and now under Profecution for the fame, which if they are con-; ' vi£ted for, they are not liable to make good the faid Defects ; fo that the Mifchiefs from Fire,
