C. 35. 717 king any Fee, Gratuity or Reward for examining, viewing or delivering fuch Pitch, Tar or other naval Stores, with Refpedt to the Premium, and for the making or figning a Certificate, in order to the receiving fuch Premium or Reward, fhall be continued and put in Practice during the Continuance of this Act, the feveral Matters, Things and Penalties were again repeated and re-enacted in the Body of this prefent Act ; any Law, Cuftom or Ufage to the contrary notwithstanding. 'XL And whereas by an Adt patted in the eighth Year of his late Majefty's Reign, intituled, Sin Slcl gccc. i. c tl .* giving further Encouragement for the Importation of naval Stores, and for other Purpofes therein mentioned, a ' particular Method is prefcribed for the making of Tar from green Trees prepared for that Purpofe; and,

a further Encouragement therefore for the making of Tar according to the Directions, of the faid Act, be it further enacted, That all and every Perfon an d Perfons that {hall import or can "c to be imported into this Prcm'i Kingdom, any clean, good, merchantable, weli conditioned Tar, clear of Drofs or Water, and fit in i ;can Refpedt for making Cordage, made from Trees prepared as aforefaid, according to the Directions of the faid T:;r " Adt of the eighth 'Year of his late Majefty's Reign, fliall receive, as a Premium for the fame, fdui per "Tun, containing eight Barrels, and each Barrel to gauge thirty-one Gallons and one Half, to be well hooped and filled up, on the Importation thereof: Provided always, that the Importer of fuch Tar, before he be intitled to any Reward or Premium for the fame, (hall produce to the proper Officers of his Majefty's Cuftoms (who are to, grant Certificates upon the Importation of Tar) fuch Certificate upon Oath, that all the faid Tar was made without Mixture of any other Tar therewith, according to the Directions of the faid Act, as in the faid Adt for that Purpofe is particulaily mentioned and required. ' XII. And whereas there are in feveral Parts of North Britain commonly called Scotland, great Store of ' Pine and Fir Trees fit for Mads, Yards and Bowfprights, but the Lands and Woods which may yield fuch ' Naval Stores, are moftly in Parts mountainous and remote from navigable Rivers; therefore, for the En- ' couragement of the Proprietors of fuch Lands and Woods, in the making Roads, Paftages and Rivers in ■ ' thofe northern Parts ufeful and commodious to the Publick, as well as for conveying fuch Trees fit for 4 Malts, Yards and Bowfprights to Sea Ports in North Britain, to be brought by Sea to that Part of Great ' Britain called England :' Be it enacted by the Authority aforefaid, That every Perfon or Perfons, or Bodies p rern j„ m r or Corporate, that fliall, from and after the twenty-ninth Day of September one thoufand feven hundred and importing Trees twenty-nine, during the Time limited for the granting of Premiums to the Importers of Naval Stores from fitfor Mafts, &c. America by Virtue of this Act, bring from North Britain aforefaid, into any Port of South Britain aforefaid, from Scotland, any Trees of twelve Inches Diameter and upwards, fit for Malts, Yards or Bowfprights, regularly con- verted and hewed at leaft into eight Squares, found, frefti and in good and merchantable Condition, {hall have and receive as a Reward or Premium for bringing fuch Naval Stores from North Britain to South Bri- tain, for fuch Trees fit for Yards, Mafts or Bowfprights per Tun (allowing forty Foot to each Tun, Girt- rheafure, according to the cuftomary Way of meafuring round Bodies) the Sum of one Pound, which faid Reward and Premium (hall likewife be paid and anfwered, in good and lawful Money of Great Britain, by the Commiffioners or principal Officers of his Majefty's Navy, who are hereby required and impowercd to make out a Bill or Bills to be paid in Courfe for the fame, upon Certificate of the refpective Chief Officer or on certificate Officers of the Cuftoms in any Port of South Britain where fuch Trees fit for Mafts, Yards or Bowfprights from thechief fliall be imported as aforefaid ; fuch Bill or Bills to be made out and given to the Perfon or Perfons, or Bodies Officer at the Corporate, importing the fame as aforefaid, within twenty Days after the Difcharge and Unlading of the place . ct Im ~ Ship or VefTel, Ships or Veflels in which fuch Trees fliall be imported, upon a Certificate or Certificates to P ort;ltlon > be produced to the Chief Officer or Officers of the Cuftoms where fuch Trees fliall be imported, which Certificate or Certificates (hall be under the Hands and Seals of the Comptroller and Collector of his Ma- and the Com jefty's Cuftoms, and fuch Naval Officer as his Majefty (hall think fit to appoint, or any two of them, reft- trailer, &c. of ding at any fuch Port or Ports in North Britain -as his Majefty under the Great Seal of Great Britain fhall the cuftoms think fit to appoint, where fuch Trees (hall be imbarked or {hipped, in order for importing the fame into where the Trees any Port of South Britain, that before the Departure of fuch Ship or Veflel, Ships or VelTels, the Perfons, arefirft tipped* Traders or Factors concerned or employed in cutting down fuch Trees, or any two of them, had made Affi- davit in Writing before fuch Comptroller and Collector of his Majefty's Cuftoms in North Britain, and fuch Naval Officer as his Majefty (hall think fit to appoint, or any two of them, that fuch Trees, fo brought to fuch Part of North Britain, were truly and bona fide of the Growth and Produce of North Britain afore- faid ; in which Affidavit the particular Number, Quantity and Qualities of fuch Trees, together with the Time when fuch Trees were cut down, the Names of the Proprietors thereof, and the Place or Places where the fame did grow, fhall be fully and plainly fpecified and contained ; which Affidavits the/aid Comp- troller and Collector of his Majefty's Cuftoms in North Britain, and fuch Naval Officer as his Majefty fhall think fit to appoint, or any two of them, are hereby impowered to take, and to adminifter fuch Oath as. aforefaid, and the fame Affidavits to keep in their Cuftody, and in which Certificate a true Copy of fuch Affidavit fliall be inferted ; as likewife upon Oath to be made within any Port of South Britain, by the Ma- and e -i O.nhof Iter or Matters of fuch Ship or Veflel, Ships or Veflels importing fuch Trees, that the fame were truly laden ,he " ,ftir cf on board fuch Ship or Veflel, Ships or Veflels within North Britain aforefaid, and that he or they know or Shlp ' believe, that the faid Trees were of the Growth of North Britain aforefaid : Provided always, That the ^^"^ of Pre-emption or Refufal of fuch North Britijh i rees be offered and tendred to the Commiffioners of his Ma- th ° Pl ™£ V^ 6 jefty's
