A. D. 1747. Anno vlcefimo Georgi I II. C. 11, 12. 2r XLVIII. And it is hereby enaiSted by the Authority aforefaid, That if at any Time or Times the Produce Dcfiaencies, of the iaid feveral Rates and Duties fliall happen to be fo low or deficient as that the Monies arifing there- &c. to be - from into the Exchequer, fhall not be fuflicient to pay and difcharge the feveral and refpeftive Annuities, tnadz gt.tii. and other Charges direfted to be paid thereout, at the End of any or either of the refpedive half-yearly Days of Payment, at which the fame are hereby direded to he paid, then, and fo often, and in every fuch Cafe, fuch Deficiency or Deficiencies (hall and may be fupplied out of the Overplus Monies, that {hail or may happen to arife and be paid into the Exchequer in any of the fubfequent half Years, as the faid re- fpeftive Annuities fhall, from tim:? to time, become due and payable ; and in cafe fuch Overplus Monies {hall not be fufficient to fatisfy the Deficiencies hereby intended from time to time to be paid thereout, that then, and in every fuch Caie, the Deficiencies fo from time to time happening, fliall, from time to time, be anfwered and made good by and out of the firil: Supplies which ftiall be granted in Parliament next after fuch Deficiencies (hall appear ; and in cafe no fuch Supplies fhall be granted within fix R'lonths next after fuch Deficiencies fhall happen, then the fame fhall be made good out of any the Monies which at any Time or Times fliall be or remain in the Receipt of the Exchequer, of the Surplufl'es, Excefles, or Overplus Monies, commonly called The Suiiing Fund (except fuch Monies of the fame Sinking Fund as are appropriated to any particular Ufe or Ufes by any former Ai£l or Afts of Parliament in that Behalf) and fuch Monies of the faid Sinking Fund fliall and may be from time to time iffued and applied accordingly ; and if at any Time or Times before any Monies of the faid feveral Rates and Duties hereby granted fliall be brought into the Exchequer as aforefaid, there fliall happen to be a Want of Money for paying the feveral Annuities afore- faid, which fliall be adluaJly incurred and grown due at any of the faid half-yearly Days of Payment before mentioned, that then, and in every fuch Cafe, the Money fo wanted fhall and may be fupplied out of the Monies of the faid Sinking Fund (except as before excepted) and be iflued accordingly. XLIX. Provided always, and be it enabled by the Authority aforel'aid. That whatfoever Monies fliall be sinking Fund fo iflued out of the faid Sinking Fund, fliall from time to time be replaced by and out of the firfl Supplies, to to be replaced. be then after granted in Parliament. L. Provided always, and be it further enafted by the Authority aforefaid, That in cafe the Monies arifen. Surplus Monies or to arife into the Receipt of his Majefly's Exchequer, of or for the Rates and Duties by this A3: granted, how to be ap- fhall be more than fufficient to anfwer and pay the feveral Annuities by this AB: charged thereupon, it fliall P^*^' and may be lawful to and for the faid Commiffioners of the Treafury, or any three or more of them now being, or the faid High Treafurer, or any three or more of the Commiffioners of the Treafury for the time being, and they are hereby refpedtively authorized and required, from time to time, to iflTue and pay, out of the Surplus Money of the faid Rates and Duties by this A(St granted as aforefaid, fo much Money as fliall^ from time to time, be wanting to make good any Deficiency that fliall or may happen in the Produce of the Rates and Duties upon Houfes, Windows or Lights, granted to his Majefty, his Heirs and SuccefTors, by. one other Aft of this prefent Seflion of Parliament ; any thing herein contained to the contrary in any wife notwithftanding. LI. Provided alfo, and be it further enacted by the Authority aforefaid, That at any Time upon one ciaufe of Rei r Year's Notice to be printed in the London Gazette, and affixed upon the Royal Exchange in London, by Au- demption. thority of Parliament, at any of the half yearly Feaft Days, for Payment of the faid refpeftive Annuities, and upon Repayment by Parliament, of the refpective Principal Sums, for which the faid refpective Annui- ties (hall be payable to fuch refpective Perfons or Corporations, as (hall be intitled to the fame Annuities, and alfo upon full Payment of all Arrearages of the fame Annuities ; then, and not till then, the faid re- fpective Annuities fhall ceafe and determine, and be underftood to be redeemed ; and from and after fuch Re- demption, the Monies arifing from the faid feveral Rates and Duties, (hall not be ilTued or applied to any Ufe or Ptirpofe, but as (hall be directed by future Act or Acts of Parliament ; and that any Vote or Refo- lution of tlie Hoiife of Commons fignified by the Speaker in Writing, to be inferred in the London Gazette^ and affixed on the Royal Exchange in London as aforefaid, (hall be deemed and adjudged to be fufficient No- tice, within the Words and Meaning of this Act. LIE And it is hereby enacted by the Authority aforefaid. That if any Perfon or Perfons (hall be molefl:ed or profecuted for any thing done by virtue or in purfuance of this Act, or any the Claufes therein contained, fuch Perfon or Perfons fliall and may plead the General IlTue, and give this Act, and the Special Matter in General Iffue.. Evidence for his, her or their Defence ; and if afterwards a Verdict (hall pafs for the Defendant or De- fendants, or the Plaintiff or Plaintiffs fhall difcontinue his or their Action, or be nonfuited, or Judgment fliall be given againft him or them, upon Demurrer or otherwife, then fuch Defendant or Defendants (hall TreUe Colb. have treble Cofts to them awarded againft fuch Plaintiff or Plaintiffs.
