D. 1756. vate Men, fhall pay the feveral Sums herein after-mentioned to be payable out of the Subfiftence-money for Diet and Small Beer, to the Non-commifTion Officers and private Men aforefaid, and not to the Inn- hojder, or other Perfon on whom fuch Non-comrniflion Officers and private Men are quartered ; any thing herein contained to the contrary notwithftanding. XIX. Provided always, and be it enacted by the Authority aforefaid, That if any Marine Officer flialJ take or caufe to be taken, or knowingly fuffer to be taken, any Money of any Perfon for excufing the Quartering of Officers or private Men, or any of them, in any Houfe allowed by this A(it ; every fuch Officer fhall be cafliiered, and be incapable of ferving in any_ military Employ- ment whatfoever. ' XX. And whereas it may be for the Benefit of the Service for the Commanding Officer to have a ' Power to exchange the Billets or Quarters of Marines quartered in the fame Town or Place ;' Be it P ,. therefore enadted by the Authority aforefaid. That the Commanding Officer of Marines in any Town OffiJ^^ma'y ^x- OY Place where fuch' Marine Forces are quartered, fhall, and he is hereby declared to have Power from change Marines time to time to exchange any Marine or Marines quartered in fuch Town or Place for any other Ma- Quarters, j-jj^g Q^ Maiines quartered in the fame Town or Place; provided the Number of Men do not exceed the Conflables to Number at that I'ime billeted on fuch Houfes refpedlively, where fuch Men (liall be exchanged ; and the biUet according- Co^ftables, Tithingmen, Headboroughs and other Chief Officers and Magiftrates of the Cities, Towns and Villages, or other Places where any of the faid Marine Forces ihall be quartered, are hereby re- quired to billet fuch Men fo exchanged accordingly. _ No Paymafter, XXI. And be it further enafted by the Authority aforefaid, That from and after the twenty-fifth tec. loriake ' Day of March one thoufand feven hundred and fifty-lix, no Paymafter, or other Officer or Perfon V.'hat- o/ra'^"&c °"' foever, (hall receive any Fees, or make any Dedudions whatloever out of the Pay of any Marine, ei- ^^' ' ther Officer or private Man, in his Majefty's Service, or from their Agents, which fhall grow due from and after the faid twenty-fifth Day of March one thoufand feven hundred and fifty-fix, other than the ufual Deductions for Clothing, and twelve Pence in the Pound to be difpofed ot as his Majefty Ihali think fit, and the one Day's Pay In the Year for the Ule of the Royal Hofpital at Chelfca, and fucli other neceflary Deduflions as (hall from time to time be direded by the faid Lord High Admiral, or three or more of the Commiffioners for executing the faid Office of Lord High Admiral for the time being, by Order in Writing under his or their refpeflive Hand or Hands. XXIL And that the- Quarters both of the faid Marine Officers and private Men while on Shore as aforefaid, may, during the Continuance of this A6t, be duly paid and_fatisfied, and his Majefty's Du- Penalty on Of- ficers taking JV'oney to ex- cufe quartering. That from and after the uven- xn tlieir Hands, ty-fifth Day of March one thoufand feven hundred and fifty-fix, every Officer or other Perfon to whom it belongs to receive, or that (hall adlually receive the Pay or Subfill:ence-money for one or more parti- cular Company or Companies of the faid Marine Forces, or otherwife, fliall immediately, upon each Receipt of every particular Sum which (hall from time to time be paid, returned or come to his or their Hands on account of Pay or Subfiftence, give publick Notice thereof to all Perfons keeping Inns, or other Places where Officers or private Men are quartered by virtue of this A6t ; and (hall alfo appoint the faid Innkeepers and others to repair to their Quarters at fuch Times as they fhall appoint, for the Di- flribution and Payment of the laid Pay or Subfiftence-money to fuch Officers or private Men, which fhall be within four Days at the fartheft after the Receipt of the fame as aforefaid ; and the faid Inn- keepers and others (hall then and there acquaint fuch Officer or Officers with the Accounts or Debts (if any (hall be) between -them and the Officers and private Men fo quartered in their refpedtive Houfes ; which Accounts the faid Officer or Officers is or are hereby required to accept of, and imme- diately pay the fame, before any Part of the faid Pay or Subfiftence be diftributed either to the Officers or private Men : Provided the faid Accounts exceed not for one Marine Commiffion Officer under the Degree of a Captain, for fuch 0(Hcer's Diet and Small Beer, per Diem, one Shilling ; and if fuch Of- ficer (hall have a Horfe or Horfes, for each fuch Horfe or Horfes for their Hay and Straw, per Dia/iy Six-pence; nor for one private Man's Diet and Small Beer, per Diem, four Pence: And if any Officer or Officers as aforefaid (hall not give Notice as aforefaid, and fhall not immediately, upon producing fuch Account ftated, fatisfy, content and pay the fame; upon Complaint and Oath made thereof by SuiVfiftence-nio- any two WitnefiTes, at the next Quarter-Seffions for the County or City wherein fuch Quarters were C^^a'rws "^^^'"^ (which Oath the Juftices of the Peace at fuch Selfions are hereby authorized and required to adminifter) the Paymafter or Perfon for the time being authorized to pay the faid Marine Forces, is hereby required ^%^?iem°out ^'^'^ authorized (upon Certificate of the (aid Juftices, before whom fuch Oath was made, of the Sum of Officers Ar- due Upon fuch Accounts, and the Perfons to whom the fame is owing) to pay and fatisfy the faid Sums f^afS' out of the Arrears due to the faid Marine Officer or Officers?; upon Penalty that fuch Paymafter or Per- fon fhall forfeit their refpedtive Place or Places of Paymafter or otherwife, and be difcharged from hold- ing the fame for the future. And in cafe there (hall be no Arrears due to the faid Officer or Officers, then the faid Paymafter or Perfon for the time being authorized to pay the faid Marine Forces, is here- by authorized and required to dedudl the Sums he ftiall pay purfuant to the Certificate of the faid Ju- ft:ces, out of the next Pay or Subfiftence-money of the Company to which fuch Officer or Officers fliall belong ; and fuch Officer or Officers (hall for fuch their Offence, or for neglediing to give Notice of the Receipt of fuch Pay or Subfiftence-money as aforefaid, be deemed and taken, and ai'e hereby de- clared ipfjfatlo calhiered. < Rates ofSub- firtcnce to be paid to Inn- keepers, &c.
