That in cafe there fhall not be a fufficient Number of Commi/lioners for any fortheCounty City, Borough, Town, Port or Place oi Great Britain (for which by this Adl CommifHoners are fpecially at large, &c. appointed) capable of adling according to the refpedtive Qualifications required by this Aft, then and in Cav^&c.*^"^ every fuch Cafe, any the Commiflioners appointed for the County, Shire or Stewartry at large, within ' which fuch City, Borough, Town or Place doth Hand, or which is next adjoining thereto, may z£t as Commiflioners in the Execution of this Aft, within fuch City, Borough, Town, Port or Place • any tiling herein contained to the contrary notwithltanding. Qjaiification of X'XXV^III. Provided always, and be it enafted by the Authority aforefaid. That no CommifTioner of Commiflioners jj^g Land Tax, not being a Juftice of the Peace, or a Magiflrate of a Corporation or a Borough, °^] wilh^n *' ^^^^^ ^^ capable of afting as a Commiflioner in the Execution of this Aft, or of any of the Powers therein Ingland. contained, in or for any County at large within England^ the Dominion oi Wales (the Counties oi Jngle- fey, Merioneth, Cardigan, Caermarthen, Glamorgan, Montgornery, Pembroke, Caernarvon and Monmouth ex- cepted) or in or for any of the Ridings in the County oiYork, unlefs fuch Perfon by himfelf, or his Te- nants or Truftees was taxed, or did pay in the fame County or Ridjng, for the Value of one hundred Pounds fer Annum or more of his own Eftate, by wtue of the faid Aft, for the Land Tax made and palled in England the twenty-eighth Year of his Majefty's Reign, or any fubfequent Aft or A(5ts of Parliament for that Purpofe, or unlefs fuch Perfon fo appointed to be a Commiiflioner, fhall at the Time of the Exe- cution of this Aft, by himfelf, his Tenants or Truftees, enjoy an Eftate of Lands, Tenements, or He- reditaments, of the faid yearly Value of one hundred Pounds or more within the faid County or Riding refpcftively ; any Thing herein contained to the contrary notwithftanding. Perfons difabled XXXIX. And it is hereby further enafted, That if any Perfon intended by this Aft to be difablcd for prefuming to act, the Caufe laft mentioned, fhall neverthelefs prefume to aft as a Commiflioner in the Execution of this iorfcit 50I. ^^c^^ Qj. ^jjy of the Powers therein contained, every fuch Perfon for fuch OiFcnce fhall forfeit the Sum of fifty Pounds, to any Perfon or Perfons who will inform or fue for the fame, to be recovered in any of his Majefty's Courts of Record at TVcJhninJlcr, or in the Exchequer of Scotland zs aforefaid. Commiflioners XL. Provided neverthelefs, and it is hereby enafted. That no Perfon who is appointed to be a Com- may act for any miflloner for executing this Aft in any Part of Great Britain, fhall be difabled for the Caufe laft-mentioned habtan^ts"^or°" ^^^^ afting as a Commiflioner, within and for any City, Borough, Cinque Port, or Corporate Town only Inns of Court, whcreof he fliall be an Inhabitant at the Time of the Execution of this Aft, or from afting as a Conimif- fioner within any of the Inns of Court or Inns of Chancery.

  • XLI. And whereas fome Doubts may arife whether JVlayors, Bailiffs, and other chief Magiftrates of

Cities, Boroughs, Towns Corporate and Cinque Ports, for which CommiflRoners are fpecially appointed by virtue of this Aft, can aft as Commiflioners for executing this Aft in the faid Cities, Boroughs I'owns Corporate and Cinque Ports ;' Be it further enafted by the Authority aforefaid, That all May- ors, Bailiffs, and other chief Magiftrates who are appointed CommiflTioners for executing this Aft fhall Commiflioners ]^q^ ^^^ have Power to Aft as Commiflioners for executing this Aft, within and for any City, Borouf^'h ^^^itmI ^^' Town Corporate or Cinque Port, wherein they inhabit at the Time of executing this Aft, as well where ^' * Commiflioners are fpecially appointed by this Aft, as where they are not. ' XLII. And whereas it may often be expedient for his Majefty's Service, that the Commiflioners

That the Mayor or other chief ufonNotice from Magiftratc of every City, Town or Place, fhall (upon receiving Notice for that Purpofe from the Secre- 'w^"o*"'forM tary at War) immediately proceed to put this Aft in Execution within' their refpeftive Jurifdiftions, in fhi"Act within the fame Manner, to all Intents and Purpofes, as if fuch Mayor, or other chief Magiftrate, had recei'ved bis Jurifdiciion. fuch Notice from the Sheriff of the County in which fuch City, Tov/n or Place fhall be refpeftively fitu- ate ; any thing in this Aft contained to the contrary notwithftanding. BiilfTs Followers XLIII. And it is hereby provided ajid enafted. That no Bailift's Follower or Afliftant, employed or aad Afliftanfj, beicHging to any Sheriff, Bailift'or Liberties, Marfhalfea Court, or any other Perfon or Perfons that fhall V^liAcx^ ^^ *° employed, by any one that fhall have the Power of executing any Warrant or Proccfs whatfoever ^ '* ' fhall be deemed thereby to follow or exercife any Calling or Employment, or to have a fufficient Support and Maintenance within the Intent and Meaning of this Aft. empted from the fame during the Time aforefaid, provided they have a Certificate under the Hands of the Minifier and of one Churchwarden or (Jvcrfetr of the Poor, or Elders of the Parifh or Place where they live, allowed under the Hand and Seal of one Juflice of the Peace of the fame County, Shire, Stewartry, Ridinp, City or Place, which Certificate fhall be g'wcn gratis. Commiflioner. « XLV. And for the more eafy and better putting this Aft in Execution;' Be it enafted by the Autho- rity aforefaid. That any three or more CommiflTioners for putting this Aft in Execution, in the feveral Ri- dings of the County ox Tor k (being Jufticcs of the Peace) though not all of the fame Riding, may, within the Caftle of 7'ori-, or Limits thereof, execute the Powers of this Aft. ' XLVI. And whereas divers Soldiers who have dcferted his Majefty's Service, have been harboured in
