And in cafe any Queflion hath been, or mail be made, how far any Lands or Tenements be- Commifiioners to ' lono-ing to any Hofpital or Alms -houle in England, Wales i or Berwick upon Tweed, not exempted by Name determine how ' out°of this Act, ought to be affeffed and charged to the Land Tax;' Be it enacted and declared, That Songing'to'ao- the fame fhall be determined by the faid Commifiioners, or any three or more of them, or the major Part fpitais, &c. not of them then prefent, upon Appeal before them attheDay or Days by them appointed for the hearing and exempted by- determining of Appeals ; whofe Determination in fuch Cafe fhall be final. Provided always, and it is hereby enacted, That all fuch Lands, Revenues or Rents, belong- be char S ed - or to any charitable or pious Ufes, as aforefaid, fhall be charged, taxed or affeffed by virtue of this prefent Act, other, towards the faid Sum to be raifed in England, Wales, and Berwick upon Tweed, as aforefaid ; any 1 hing herein contained to the contrary notwithstanding. XXVII. And it is hereby further enacted, That all and every Auditors, Reeves, Receivers, and their De- Receivers ofFce. puties, who audit or receive any Fee-farm Rents, or other chief Rents (arifing in England, Wales, or Ber- [ arn ?. Rents ' &c «  wici uponTweed) due to his Majefty, or toany Perfon or Perfons claiming by any Grant or Purchafe from p^nd^o^'he" or under the Crown, fhall allow four Shillings for every Pound of the faid Rents, and a proportional Rate patties, without for any greater Sum than ten Shillings, to the Party or Parties paying the fame, without any Fee for fuch Fee, on Penalty Allowance, upon the Penalty of twenty Pounds to the Party grieved, to be recovered by Action of Debt, of 2ol> or upon the Cafe, together with full Cofts of Suit ; any t hing in this Act contained to the contrary thereof in any wife notwithstanding. And if any fuch Auditor of the Revenues, or any of them, belonging to his Auditors, &-c. Majefty, or any Deputy, or any other Perfon acting for or on the Behalf of any fuch Auditor, fhall, in !j:' dn 6 tenants the Account of any Reeve, Receiver, or otherwife, let infuper any Tenant or other Perfon, or make any '$!$£#£'£ fuch Tenant or other Peifon, or his or their Eftate, luble to any Diftrefs, Forfeiture or Vexation whatfo- lowed, orrefufmg ever, for any Sum or Sums of Money, which, by the true Intent and Meaning of this Act, ought to be Allowance, allowed after the Rate of four Shillings in the round, or fhall refufe, neglect, or delay to allow, and finally difcharge the fame in the proper Accounts wherein the fame ought to be allowed and difcharged ; that then, and for every or any fuch Offence, every fuch Auditor or Deputy, or Perfon acting forfuch Auditor, fhall forfeit the Sum of one hundred Pounds to the Party grieved, to be recovered as afor.efaid, and fhall be in- t0 forfeit i°oI. capable to enjoy his Office or Place, or any Office or Place of Truft under his Majefty. XXVIII. the publick Offices, upon Requeft to them made by the refpective Affeffors, fhall deliver gratis true Lifts &c ; t0 bedeli - or Accounts of all Penfions, Annuities, Stipends, or other annual Payments, and of all Fees, Salaries, ^rAflsfforj t0 and other Allowances, payable at the faid Receipt, or in the faid publick Offices, to any Commiflioner or Commifiioners, Officer or Officers, for the Execution of this Act, for the better Guidance of the faid Affeffors in the charging of the fame. And that in all Cafes where any Penfions, Annuities, Stipends, or Taxes on Pen- other yearly Payments, or the Fees, Salaries, Wages, or other Allowances or Profits charged by this Act, fio " s > &c - not fhall be payable at the Receipt of the Exchequer, or by the Cofferer of his Majefty 's Houfhold, or out of f„ t nefeh«>" any other publick Office, or by any of his Majefty's Receivers or Paymafters in England, Wales, or Ber- ,j USr . wick upon Tweed, the Tax or Payment, which in purfuance of this Act fhall be charged for or in refpect of fuch Annuities, Penfions, Stipends, Fees, Salaries, Wages, Allowances or Profits, fhall and may (in' cafe of Non-payment thereof) be detained and ftopt out of the fame, or out of any Money which fhall be paid upon fuch Penfions, Annuities, Stipends, Fees, Salaries, Wages, Allowances or Profits, or for Arrears thereof, and be applied io the Satisfaction of the Rates and Duties not otherwife paid as aforefaid; and the proper Officers in the faid Exchequer, and other the publick Offices aforefaid, fhall keep true Accounts A true Account of all Monies ftopt, and (upon Requelt) fhall give Copies of fuch Accounts to the proper Collectors of tobe '«T»tof the fuch Monies, for the refpective Parifhes or Places where the faid Monies are affefied by this Act. _ Money ftopt.
