APPENDIX. fons neglecting or refufing to pay the Duties payable by them upon demand, are hereby made lyable to be diftrained upon or profecuted. XLIX. Provided always, that a demand at the houfe where the perfon died, upon whofe Burial any duty is payable by this Act of the money due for fuch Burial, (hall be conftrued and deemed to be a good demand thereof by virtue of this Act. L. And whereas in Cities, Corporations, and other great Towns, where' there are more Parifhes than one, and the poor people in the fame do generally live in the skirts or outfides of fuch Cities, ■Corporations, and other great Towns : And in cafe fuch poor Parifhes mould, by virtue of this Act, be liable to pay the lax laid upon the burial of every perfon which received Alms within their refpective Parifhes, it would be extreamly burthenfome : For remedy whereof, Be it enacted by the authority aforefaid, that the Churchwardens and overfeers of every Parifh, in every City or Corporation, or Liber* ties or Suburbs thereof, and of every great Town, who have more Parifhes than one, as aforefaid, fhall during the continuance of this Act, upon or before the Tenth day of May in every year, deliver unto the Mayor, Chief Magiftrate, or Head Officer or Officers of every fuch City, Corporation or great Town, a Schedule, or "Lift in Writing, which fhall contain the Name of every Poor perfon Buried in their refpective Parifhes within the year preceding, and for whofe Burial they paid the Duty impofed by this Act; upon the delivery whereof fuch Churchwardens, Overfeers of the poor, or fome of them, fhall make Oath before the faid Mayor, Juftice of the Peace, Chief Magiftrate, or Head Officer, of the truth of the faid Schedule or Lift (which Oath they are refpectively hereby impowered to adminifter) and after delivery of fuch Schedule or Lifts, in manner aforefaid, the faid Mayors, Chief Magistrates, or other Head Officers, (hall refpectively caufe all the faid fums, fo paid by the faid refpective Church- wardens or Overfeers of the poor, upon the Burial of evrey fuch poor perfon in the faid feveral Sche- dules mentioned to be taxed upon the feveral Cities, Corporations and great Towns in general, with other charges for relief of the Poor, and in the like manner, and within Two months after the fame fhall be aileffed, fhall caufe payment to be made to the refpective Churchwardens and Overfeers of the Poor for the year preceding, of all fuch fum and fums of money as they refpectively paid in their refpec- tive Parifhes, for the Burial of poor perfons in the fame year. LI. And be it further enacted by the authority aforefaid, That fuch Receiver or Receivers Gene- ral, or other perfon or perfons who is or fhall be imployed in the receiving, collecting or paying the fe- veral Duties upon Marriages Births and Burials, and alfo upon Baichelors arid Widowers by this Act granted, fhall and are hereby required, between the Firft day of May, One thoufand fix hundred ninety fix, and the Firft day of November, following, and fo from year to year yearly at thofe times, during the continuance of this Act, to deliver in their refpective accounts thereof to his Majefties Auditors of the Imprefts for the time being, or one of them, who fhall be, and are hereby from time to time refpec- tively authorized to examine upon Oath the faid Receiver or Receivers General, or other perfon or per- fons Accomptants, which are or fhall be imployed in raifing, receiving and collecting the faid duties, of what fum or fums of money was or were by them or any of them refpectively raifed, collected or re- ceived within the time of fuch their accounts, and likewife what part thereof was by them or any of them paid into the Receipt of his Majefties Exchequer, or by virtue of any Warrant of Privy Seal, or Warrant of the Lord High Treafurer, or Commiffioners of his Majefties Treafury for the time being, otherwife paid, and to whom, and for what fervice or fervices ; and in making the faid accounts to and before the faid Auditors, or one of them, they are to produce proper Vouchers for every fum or fums of money fo by them or any of them raifed, received and paid, according to the ancient methods of the Exchequer, to the end it may appear upon Record, what the fame amounted to in a year, for which fuch account or accounts fhall be made, and what thereof was paid, and to whom, and for what ufe and fervice, ufes and fervices, as aforefaid, and what remains unpaid, and refts infuper upon each re- fpective Receiver and Collector ; and fuch account or accounts fo to be taken by the faid Auditor, is and are to be declared before the Lord Treafurer or Lords Commiffioners of the Treafury, and Chan- cellor of the Exchequer, now and for the time being, according to the courfe of the Exchequer in fuch cafes. LII. And be it further enacted by the authority aforefaid, That no perfon fhall be Married at any S Place pretending to be exempt from the Vilitation of the Bifhop of the Diocefs, without a Licence firft had and obtained, except the Banns fhall be Publifhed and Certified according to Law; and that every Parfon, Vicar and Curate, who fhall Marry any perfons contrary to the true intent and meaning hereof, ftnl] forfeit the fum of one hundred pounds, to be recovered by action of debt, bill, plaint or informa- tion in any of his Majefties Courts of Record, one moiety whereof to the King, his Heirs and Suc- ceffors, and the other moiety to the Informer who fhall Sue for the fame, and fhall for the Second of- fence be Sufpended ah Officio & Beneficio, for the fpace of Three years. LIII. And whereas the Fellows, Students, Scholars and Exhibitioners of the Foundations or En- dowments of any Colledge or Hall in the two Univerfities, are, by the Statutes in their refpective Col- ledges and 'Halls, to be displaced from their Places and Maintenance therein, if they fhall Marry: Beit enacted by the authority aforefaid, That the Rates and Taxes by this Act impofed, or to be impofed on Batchelors, fhall not extend to fuch Fellows, Students or Scholars of Houfes, or Scholars hav- ing Exhibitions in any fuch Colledges or Halls; anything herein contained to the contrary notwith- ftanding. LIV. Provided always, and be it further enacted, That where any perfon under the Age of One and twenty years, fhall not be Refident at the time of his or her Death, with his or her Father or Mother, that in fuch cafe the Mafter or Miftrefs of the Family or Houfe where fuch perfon fhall die, fhall pay the feveral duties and fums of money, which fhall become due and payable, by virtue of this Act, for 3 - and
