Upon looking over the constitution it does not appear that the national legislature can erect light hou.?.? or clean out or preserve the navigation of barbours--This expence ought to be borne by commerce--of course b7 the general treasury into which all the revenue of commerce must come- Is it proper to declare all the navigable waters or rivers and within the U.S. common high ways? Perhaps a power to restrain any State from demanding tribute from citizens of another State in such cases is comprehended in the power to regulate trade between State and State. This to be further considered. A motion to be made on the light house etc, to-morrow.
