(a) For purposes of elig\177blhty for duty-free treatment under subheadrag 9821 01.01, such tuna-- (1) must be harvested by Unned States vessels or by ATPDEA beneficiary country vessels, and 00 must have been prepared or preserved in any manner in an ATPDEA beneficiary country enuraerated in note I to tNs subchapter Such tuna shall enter the Urnted States free of any quantitative restrictions. (b) The term "United States vessels" Includes any vessel having a certificate of documentation wlth a fishery endorsement under chapter 121 of tale 46, Urnted States Code; and the tcrna "ATPDEA beneficiary country vessels" includes any vessel (0 whlch \177s registered or recorded in an ATPDEA benehcmry country enumerated in note I to this subchapter, (u) which sails under the flag of such an ATPDEA beneficiary country, (iti) which iq at least 75 percent owned by nationaN of such an ATPDEA benefimary country or by a company having its pnnclpal place of business \177n such an ATPDEA benefictary country, of whmh the manager or managers, chairalan of the board of directors or of the supelwlsory board and the majority of the members of such boards are nationals of such an ATPDEA beneficiary country and of which, in the case of a company, at least 50 percent of the capital is owned by such an ATPDEA beneficiary country or by pubhc bodies or nationals of an ATPDEA beneficiary country, (iv) of which the master and officers are natlonals of such an ATPDEA beneficiary colintry; and 162
