[H.R. 5759] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 4(1)(2) of the Age Discrimination in Employment Act of 1967, as added by the Older Workers Benefit Protection Act, is amended— 29 USC 623. (1) in subparagraph (A)— (A) in clause (i) by striking "and" at the end, (B) in clause (ii) by strildng the comma at the end and inserting "; or", and (C) by inserting after clause (ii) the following: "(iii) the values described in both clauses (i) and (ii);", and (2) in subparagraph (D)— (A) by inserting after "For purposes of this paragraph" the following: "and solely in order to make the deduction authorized under this paragraph", (B) by striking "and" at the end of clause (i), (C) by striking the period at the end of clause (ii) and inserting "; or", and (D) by adding at the end the following new clause: "(iii) the package of benefits provided by the employer is as described in clauses (i) and (ii).".
