PUBLIC LAW 102-233—DEC. 12, 1991 105 STAT. 1761 Public Law 102-238 102d Congress An Act To provide funding for the resolution of failed savings associations and working capital for the Resolution Trust Corporation, to restructure the Oversight Board and the Resolution Trust Corporation, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1, SHORT TITLE. This Act may be cited as the "Resolution Trust Corporation Refinancing, Restructuring, and Improvement Act of 1991". TITLE I—RESOLUTION TRUST CORPORATION REFINANCING Dec. 12, 1991 [H.R. 3435] Resolution Trust Corporation Refinancing, Restructuring, and Improvement Act of 1991. Banks and banking. 12 USC 1421 note. SEC. 101. THRIFT RESOLUTION FUNDING PROVISIONS. Section 21A(i) of the Federal Home Loan Bank Act (12 U.S.C. 1441a(i)) is amended by adding at the end the following new paragraph: "(3) ADDITIONAL INTERIM FUNDING.—In addition to amounts provided under paragraph (2), the Secretary of the Treasury shall provide to the Corporation such sums as may be necessary not to exceed $25 billion to carry out the purposes of this section until April 1, 1992.". SEC. 102. APPOINTMENT BY DIRECTOR OF THE OFFICE OF THRIFT SUPERVISION. Section 11(c)(6)(B) of the Federal Deposit Insurance Act (12 U.S.C. 1821(c)(6)(B)) is amended to read as follows: "(B) RECEIVER.—Whenever the Director of the Office of Thrift Supervision appoints a receiver under the provisions of section 5(d)(2)(C) of the Home Owners' Loan Act for the purpose of liquidation or winding up any savings associations 3.ifi3.irs^^ "(i) before October 1, 1993, the Resolution Trust Corporation shall be appointed; "(ii) after September 30, 1993, the Resolution Trust Corporation shall be appointed if the Resolution Trust Corporation had been placed in control of the depository institution at any time on or before such date; and "(iii) after September 30, 1993, the Corporation shall be appointed unless the Resolution Trust Corporation is required to be appointed under clause (ii).". SEC. 103. EXTENSION OF RESOLUTION TRUST CORPORATION DUTY. (a) IN GENERAL.— Section 21A(b)(3)(A)(ii) of the Federal Home Loan Bank Act (12 U.S.C. 1441a(b)(3)(A)(ii)(II)) is amended to read as follows:
