108 STAT. 3612 PUBLIC LAW 103-382—OCT. 20, 1994 tion where such rule or regulation must be issued within a very limited time to assist local educational agencies with the operation of the program under this title, the State educational agency may issue a regulation without prior consultation, but shall immediately thereafter convene the State committee of practitioners to review the emergency regulation prior to issuance in final form. "(c) PAYMENT FOR STATE ADMINISTRATION. —Each State may reserve for the proper and efficient performance of its duties under this title the greater of— "(1) 1.00 percent of the funds received under subsections (a), (c), and (d) of section 1002; or "(2) $400,000, or $50,000 in the case of the outlying areas. 20 USC 6514. "SEC. 1604. CONSTRUCTION. "(a) PROHIBITION OF FEDERAL MANDATES, DIRECTION, OR CON- TROL.—Nothing in this title shall be construed to authorize an officer or employee of the Federal Government to mandate, direct, or control a State, local educational agency, or school's specific instructional content or pupil performance standards and assessments, curriculum, or program of instruction as a condition of eligibility to receive funds under this title. "(b) EQUALIZED SPENDING. —Nothing in this title shall be construed to mandate equalized spending per pupil for a State, local educational agency, or school. "(c) BUILDING STANDARDS.— Nothing in this title shall be construed to mandate national school building standards for a State, local educationgd agency, or school.

PROFESSIONAL DEVELOPMENT PRO- GRAM 20 USC 6601. " SEC. 2001. FINDINGS. 'The Congress finds as follows: "(1) Reaching the National Education Goals, particularly the third, fourth, and fifth National Education Goals, requires a comprehensive educational reform strategy that involves parents, schools, government, communities, and other public and private organizations at all levels. "(2) A crucial component of the strategy for achieving such goals is ensuring, through sustained and intensive high-quality professional development, that all teachers will provide challenging learning experiences in the core academic subjects for their students. "(3) Decisionmaking as to what activities a State or local educational agency should undertake to improve teaching and learning are best made by individuals in the schools closest to the classroom and most knowledgeable about the needs of schools and students. "(4) The potential positive impact of high-quality professional development is underscored by recent research findings that—
