PUBLIC LAW 104-193—AUG. 22, 1996 110 STAT. 2309 SEC. 805. DEFINITION OF HOMELESS INDIVIDUAL. Section 3(s)(2)(C) of the Food Stamp Act of 1977 (7 U.S.C. 2012(s)(2)(C)) is amended by inserting "for not more than 90 days" after "temporary accommodation". SEC. 806. STATE OPTION FOR ELIGIBILITY STANDARDS. Section 5(b) of the Food Stamp Act of 1977 (7 U.S.C. 2014(d)) is amended by striking "(b) The Secretar/' and inserting the following: "(b) ELIGIBILITY STANDARDS.— Except as otherwise provided in this Act, the Secretary". SEC. 807. EARNINGS OF STUDENTS. Section 5(d)(7) of the Food Stamp Act of 1977 (7 U.S.C. 2014(d)(7)) is amended by striking "21" and inserting "17". SEC. 808. ENERGY ASSISTANCE. (a) IN GENERAL. —Section 5(d) of the Food Stamp Act of 1977 (7 U.S.C. 2014(d)) is amended by striking paragraph (11) and inserting the following: "(11)(A) any payments or allowances made for the purpose of providing energy assistance under any Federal law (other than part A of title IV of the Social Security Act (42 U.S.C. 601 et seq.)), or (B) a 1-time payment or allowance made under a Federal or State law for the costs of weatherization or emergency repair or replacement of an unsafe or inoperative furnace or other heating or cooling device,". (b) CONFORMING AMENDMENTS.— Section 5(k) of the Food Stamp Act of 1977 (7 U.S.C. 2014(k)) is amended— (1) in paragraph (1)— (A) in subparagraph (A), by striking "plan for aid to families with dependent children approved" and inserting "program funded"; and (B) in subparagraph (B), by striking ", not including energy or utility-cost assistance,"; (2) in paragraph (2), by striking subparagraph (C) and inserting the following: "(C) a payment or allowance described in subsection (d)(ll);"; and (3) by adding at the end the following: "(4) THIRD PARTY ENERGY ASSISTANCE PAYMENTS.— "(A) ENERGY ASSISTANCE PAYMENTS.— For purposes of subsection (d)(1), a payment made under a State law (other than a law referred to in paragraph (2)(H)) to provide energy assistance to a household shall be considered money payable directly to the household. "(B) ENERGY ASSISTANCE EXPENSES.— For purposes of subsection (e)(7), an expense paid on behalf of a household under a State law to provide energy assistance shall be considered an out-of-pocket expense incurred and paid by the household.". SEC. 809. DEDUCTIONS FROM INCOME. (a) IN GENERAL.— Section 5 of the Food Stamp Act of 1977 (7 U.S.C. 2014) is amended by striking subsection (e) and inserting the following: "(e) DEDUCTIONS FROM INCOME.— "(1) STANDARD DEDUCTION.— The Secretary shall allow a standsird deduction for each household in the 48 contiguous
