PUBLIC LAW 105-85—NOV. 18, 1997 111 STAT. 1725 (1) by striking out "grade—" in the matter preceding paragraph (1) and inserting in heu thereof "grade any of the following officers:"; (2) by striking out "an officer" in each of paragraphs (1), (2), and (3) and inserting in lieu thereof "An officer"; (3) by striking out the semicolon at the end of paragraph (1) and inserting in lieu thereof a period; (4) by striking out "; or" at the end of paragraph (2) and inserting in lieu thereof a period; (5) by redesignating paragraphs (2) and (3), as so amended, as paragraphs (3) and (4), respectively, and in each such paragraph striking out "the next higher grade" and inserting in lieu thereof "that grade"; and (6) by inserting after paragraph (1) the following new paragraph (2): "(2) An officer who is recommended for promotion to that grade in the report of an earlier selection board convened under a provision referred to in paragraph (1), in the case of such a report that has not yet been approved by the President.". (c) CLARIFYING AMENDMENTS. —Paragraphs (3) and (4) of section 14301(c) of such title, as redesignated and amended by subsection (b), are each amended by inserting before the period at the end the following: ", if that nomination is pending before the Senate". (d) EFFECTIVE DATE. —The amendments made by this section lo use 619 note, shall take effect on the date of the enactment of this Act and shall apply with respect to selection boards that are convened under section 611(a), 14101(a), or 14502 of title 10, United States Code, on or after that date. SEC. 504. AUTHORITY TO DEFER MANDATORY RETIREMENT FOR AGE OF OFFICERS SERVING AS CHAPLAINS. (a) AUTHORITY FOR DEFERRAL OF RETIREMENT FOR CHAP- LAINS.— Subsection (c) of section 1251 of title 10, United States Code, is amended— (1) by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and (2) by inserting after paragraph (1) the following new paragraph (2): "(2) The Secretary concerned may defer the retirement under subsection (a) of an officer who is appointed or designated as a chaplain if the Secretary determines that such deferral is in the best interest of the military department concerned.". (b) AUTHORITY FOR DEFERRAL OF RETIREMENT FOR CHIEF AND DEPUTY CHIEF OF CHAPLAINS.— Such section is further amended by adding at the end the following new subsection: "(d) The Secretary concerned may defer the retirement under subsection (a) of an officer who is the Chief of Chaplains or Deputy Chief of Chaplains of that officer's armed force. Such a deferment may not extend beyond the first day of the month following the month in which the officer becomes 68 years of age.". (c) QUALIFICATION FOR SERVICE AS NAVY CHIEF OF CHAPLAINS OR DEPUTY CHIEF OF CHAPLAINS.—(1) Section 5142(b) of such title is amended by striking out ", who are not on the retired list,". (2) Section 5142a of such title is amended by striking ", who is not on the retired list,".
