(b) REPORT ON STUDY RESULTS.— (1) Not later than April 1, 2000, the Secretary of Defense shall submit to the congressional defense committees and the Committee on Environment and Public Works of the Senate a report that summarizes the results of the study conducted under subsection (a). (2) The Secretary shall include in the report recommendations regarding the continuation or termination of any ongoing use of Lake Erie as an ordnance firing range, and explain any recommendation to continue such activities. The Secretary shall conduct the evaluation and assessment in consultation with the government of the State of Ohio and local government entities and with appropriate Federal agencies. (c) LIMITATION ON EXPENDITURES.—Not more than $800,000 may be expended to conduct the study under subsection (a) and prepare the report under subsection (b). However, nothing in this section is intended to require non-Federal cost-sharing of the costs to perform the study. (d) AUTHORIZATION. — Consistent with existing laws, and after providing notice to Congress, the Secretary of Defense may work with the other relevant Federal, State, local, or private entities to remove ordnance resulting from infiltration into the Federal navigation channel and adjacent shorelines of the Toussaint River in Ottawa County, Ohio, using funds authorized to be appropriated for that specific purpose in fiscal year 2000. (e) RELATION TO OTHER LAWS AND AGREEMENTS. —T h is section is not intended to modify any authorities provided to the Secretary of the Army by the Water Resources Development Act of 1986 (33 U.S.C. 2201 et seq.), nor is it intended to modify any non- Federal cost-sharing responsibilities outlined in any local cooperation agreements. Subtitle D—Depot-Level Activities SEC. 331. SALES OF ARTICLES AND SERVICES OF DEFENSE INDUS- TRIAL FACILITIES TO PURCHASERS OUTSIDE THE DEPARTMENT OF DEFENSE. (a) WAIVER OF CERTAIN CONDITIONS. —(1) Section 2208(j) of title 10, United States Code, is amended— (A) by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively; (B) by inserting "(1)" after "(j)"; and (C) by adding at the end the following new paragraph: "(2) The Secretary of Defense may waive the conditions in paragraph (1) in the case of a particular sale if the Secretary determines that the waiver is necessary for reasons of national security and notifies Congress regarding the reasons for the waiver.". (2) Section 2553(c) of such title is amended— (A) by redesignating paragraphs (1) through (6) as subparagraphs (A) through (F), respectively; (B) by inserting "(1)" before "A sale"; and (C) by adding at the end the following new paragraph: "(2) The Secretary of Defense may waive the condition in paragraph (1)(A) and subsection (a)(1) that an article or service must
