113 STAT. 954 PUBLIC LAW 106-65—OCT. 5, 1999 SEC. 3202. UNDER SECRETARY FOR NUCLEAR SECURITY OF DEPART- MENT OF ENERGY. Section 202 of the Department of Energy Organization Act (42 U.S.C. 7132) is amended by adding at the end the following new subsection: "(c)(1) There shall be in the Department an Under Secretary for Nuclear Security, who shall be appointed by the President, by and with the advice and consent of the Senate. The Under Secretary shall be compensated at the rate provided for at level III of the Executive Schedule under section 5314 of title 5, United States Code. "(2) The Under Secretary for Nuclear Security shall be appointed from among persons who— "(A) have extensive background in national security, organizational management, and appropriate technical fields; and "(B) are well qualified to manage the nuclear weapons, nonproliferation, and materials disposition programs of the National Nuclear Security Administration in a manner that advances and protects the national security of the United States. "(3) The Under Secretary for Nuclear Security shall serve as the Administrator for Nuclear Security under section 3212 of the National Nuclear Security Administration Act. In carrying out the functions of the Administrator, the Under Secretary shall be subject to the authority, direction, and control of the Secretary. Such authority, direction, and control may be delegated only to the Deputy Secretary of Energy, without redelegation.". SEC. 3203. ESTABLISHMENT OF POLICY FOR NATIONAL NUCLEAR SECURITY ADMINISTRATION. (a) ESTABLISHMENT OF POLICY FOR ADMINISTRATION.—The Department of Energy Organization Act is amended by adding at the end of title II (42 U.S.C. 7131 et seq.) the following new section: " ESTABLISHMENT OF POLICY FOR NATIONAL NUCLEAR SECURITY ADMINISTRATION 42 USC 7144. "SEC 213. (a) The Secretary shall be responsible for establishing policy for the National Nuclear Security Administration. "(b) The Secretary may direct officials of the Department who are not within the National Nuclear Security Administration to review the programs and activities of the Administration and to make recommendations to the Secretary regarding administration of those programs and activities, including consistency with other similar programs and activities of the Department. "(c) The Secretary shall have adequate staff to support the Secretary in carrying out the Secretary's responsibilities under this section.". (b) CLERICAL AMENDMENT. —The table of contents at the beginning of the Department of Energy Organization Act is amended by inserting after the item relating to section 212 the following new item: "213. Establishment of policy for National Nuclear Security Administration.".
