118 STAT. 1908 PUBLIC LAW 108–375—OCT. 28, 2004 SEC. 545. CODIFICATION OF PROHIBITION ON IMPOSITION OF CERTAIN CHARGES AND FEES AT THE SERVICE ACADEMIES. (a) UNITED STATES MILITARY ACADEMY.—(1) Chapter 403 of title 10, United States Code, as amended by 544(a)(1), is further amended by adding at the end the following new section: ‘‘§ 4360. Cadets: charges and fees for attendance; limitation ‘‘(a) PROHIBITION.—Except as provided in subsection (b), no charge or fee for tuition, room, or board for attendance at the Academy may be imposed unless the charge or fee is specifically authorized by a law enacted after October 5, 1994. ‘‘(b) EXCEPTION.—The prohibition specified in subsection (a) does not apply with respect to any item or service provided to cadets for which a charge or fee is imposed as of October 5, 1994. The Secretary of Defense shall notify Congress of any change made by the Academy in the amount of a charge or fee authorized under this subsection.’’. (2) The table of sections at the beginning of such chapter is amended by adding after the item added by section 544(a)(2) the following new item: ‘‘4360. Cadets: charges and fees for attendance; limitation.’’. (b) UNITED STATES NAVAL ACADEMY.—(1) Chapter 603 of title 10, United States Code, as amended by 544(b)(1), is further amended by adding at the end the following new section: ‘‘§ 6979. Midshipmen: charges and fees for attendance; limita tion ‘‘(a) PROHIBITION.—Except as provided in subsection (b), no charge or fee for tuition, room, or board for attendance at the Naval Academy may be imposed unless the charge or fee is specifi cally authorized by a law enacted after October 5, 1994. ‘‘(b) EXCEPTION.—The prohibition specified in subsection (a) does not apply with respect to any item or service provided to midshipmen for which a charge or fee is imposed as of October 5, 1994. The Secretary of Defense shall notify Congress of any change made by the Naval Academy in the amount of a charge or fee authorized under this subsection.’’. (2) The table of sections at the beginning of such chapter is amended by adding after the item added by section 544(b)(2) the following new item: ‘‘6979. Midshipmen: charges and fees for attendance; limitation.’’. (c) UNITED STATES AIR FORCE ACADEMY.—(1) Chapter 903 title 10, United States Code, as amended by 544(c)(1), is further amended by adding at the end the following new section: ‘‘§ 9360.
