( 5 )F U NDING FOR IM PL EMENTATION.—In addition to funds otherwise available, for purposes of implementing the provi- sions of, and amendments made by, this section, other than the amendment made by subsection (c)(1) and other than sec- tion 1847(a)(1)(E) of the Social Security Act, the Secretary of H ealth and Human Services shall provide for the transfer from the Federal Supplementary M edical Insurance Trust Fund established under section 1841 of the Social Security Act (4 2U .S.C. 13 9 5t) to the Centers for Medicare & Medicaid Services P rogram Management Account of $ 20,000,000 for fiscal year 2008, and $25,000,000 for each of fiscal years 2009 through 2012. Amounts transferred under this paragraph for a fiscal year shall be available until e x pended. (e) EFFECTI V E DATE.—The amendments made by this section shall take effect as of J une 30, 2008. (a) IN GENERAL.—Section 1853(k) of the Social Security Act (42 U.S.C. 1395w – 23(k)) is amended— (1) in paragraph (1), in the matter preceding subparagraph (A), by striking ‘‘paragraph (2)’’ and inserting ‘‘paragraphs (2) and (4)’’; and (2) by adding at the end the following new paragraph: ‘‘(4) PHASE-OUT OF THE INDIRECT COSTS OF MEDICAL EDU- CATION FROM CAPITATION RATES.— ‘‘(A) IN GENERAL.—After determining the applicable amount for an area for a year under paragraph (1) (begin- ning with 2010), the Secretary shall ad j ust such applicable amount to exclude from such applicable amount the phase- in percentage (as defined in subparagraph (B)(i)) for the year of the Secretary’s estimate of the standardi z ed costs for payments under section 188 6 (d)(5)(B) in the area for 42USC1395mnote.R e p o r t s .
