12 2 STA T . 2 753PUBLIC LA W 11 0– 2 89—J UL Y 30 , 2008 ‘ ‘ (X)means an y se curit ya g reement o r arrange - ment or ot h er cre d it enhancement re l ated to any agreement or transaction re f erred to in this clause , including any guarantee or reim b ursement obliga- tion in connection w ith any agreement or trans- action referred to in this clause . ‘‘(iii) COM MO DITYC O N T RA CT. —T he term ‘com- modity contract ’ means— ‘‘( I ) with res p ect to a futures commission mer- chant, a contract for the purchase or sale of a commodity for future deli v ery on, or sub j ect to the rules of, a contract mar k et or board of trade

‘‘(II) with respect to a foreign futures commis- sion merchant, a foreign future; ‘‘(III) with respect to a leverage transaction merchant, a leverage transaction; ‘‘(I V ) with respect to a clearing organi z ation, a contract for the purchase or sale of a commodity for future delivery on, or subject to the rules of, a contract market or board of trade that is cleared by such clearing organization, or commodity option traded on, or subject to the rules of, a contract market or board of trade that is cleared by such clearing organization; ‘‘(V) with respect to a commodity options dealer, a commodity option; ‘‘(VI) any other agreement or transaction that is similar to any agreement or transaction referred to in this clause; ‘‘(VII) any combination of the agreements or transactions referred to in this clause; ‘‘(VIII) any option to enter into any agreement or transaction referred to in this clause; ‘‘(IX) a master agreement that provides for an agreement or transaction referred to in sub- clause (I), (II), (III), (IV), (V), (VI), (VII), or (VIII), together with all supplements to any such master agreement, without regard to whether the master agreement provides for an agreement or trans- action that is not a commodity contract under this clause, e x cept that the master agreement shall be considered to be a commodity contract under this clause only with respect to each agreement or transaction under the master agreement that is referred to in subclause (I), (II), (III), (IV), (V), (VI), (VII), or (VIII); or ‘‘(X) any security agreement or arrangement or other credit enhancement related to any agree- ment or transaction referred to in this clause, including any guarantee or reimbursement obliga- tion in connection with any agreement or trans- action referred to in this clause. ‘‘(iv) F OR W ARD CONTRACT.—The term ‘forward con- tract’ means— ‘‘(I) a contract (other than a commodity con- tract) for the purchase, sale, or transfer of a com- modity or any similar good, article, service, right,
