SEC.473 . D E FIN I T I O NS. (a) T OTAL I NCOME.—Section 480(a) (as amended by Public Law 110–84) (20 U .S.C. 108 7 vv(a)) is amended— (1) in paragraph (1)— (A) by inserting ‘‘(A)’’ after ‘‘(1)’’

( B ) by inserting ‘‘subparagraph (B) and’’ after ‘‘provided in’’; and (C) by adding at the end the following new subpara- graph

‘‘(B) N otwithstanding section 478(a), the Secretary may provide for the use of data from the second preceding ta x year when and to the extent necessary to carry out the simplification of applications (including simplification for a subset of applications) used for the estimation and determination of financial aid eligibility. Such sim- plification may include the sharing of data between the Internal Revenue Service and the Department, pursuant to the consent of the taxpayer.’’; and (2) in paragraph (2), by inserting ‘‘no portion of veterans’ education benefits received by an individual,’’ after ‘‘any pro- gram by an individual,’’. (b) UNTA X ED INCOME AND BENEFITS.—Section 480(b)(1)(E) (as amended by Public Law 110–84) (20 U.S.C. 1087vv(b)(1)(E)) is amended by inserting ‘‘, except that the value of on-base military housing or the value of basic allowance for housing determined under section 403(b) of title 37, United States Code, received by the parents, in the case of a dependent student, or the student or student’s spouse, in the case of an independent student, shall be excluded’’ before the semicolon. (c) INDE P ENDENT STUDENT.—Section 480(d)(1) (as amended by Public Law 110–84) (20 U.S.C. 1087vv(d)(1)) is amended— (1) by striking subparagraph (B) and inserting the fol- lowing: ‘‘(B) is an orphan, in foster care, or a ward of the court, or was an orphan, in foster care, or a ward of the court at any time when the individual was 13 years of age or older;’’; and (2) by striking subparagraph (C) and inserting the fol- lowing: ‘‘(C) is, or was immediately prior to attaining the age of ma j ority, an emancipated minor or in legal guardianship as determined by a court of competent jurisdiction in the individual’s State of legal residence;’’. (d) T R EATMENT OF COOPERATIVE EDUCATION W OR K INCOME.— Section 480(e) (as amended by Public Law 110–84) (20 U.S.C. 1087vv(e)) is amended— (1) by redesignating paragraphs (2) through ( 5 ) as para- graphs (3) through (6), respectively; and 20USC1 0 87t t no t e.
