( 3 ) DISA B ILITY EVAL U ATION SYSTEM.—The term ‘‘Disability E valuation System’’ means the following

(A) A system or process of the Department of Defense for evaluating the nature and e x tent of disabilities affecting members of the Armed Forces that is operated by the Secretaries of the military departments and is comprised of medical evaluation boards, physical evaluation boards, counseling of members, and mechanisms for the final dis- position of disability evaluations by appropriate personnel. (B) A system or process of the C oast G uard for evalu- ating the nature and extent of disabilities affecting mem- bers of the Coast Guard that is operated by the Secretary of H omeland Security and is similar to the system or process of the Department of Defense described in subpara- graph (A). ( 4 ) ELIGIBLE FAMILY MEMBER.—The term ‘‘eligible family member’’, with respect to a recovering service member, means a family member (as defined in section 4 1 1 h(b) of title 3 7 , U nited States Code) who is on invitational travel orders or serving as a non-medical attendee while caring for the recov- ering service member for more than 4 5 days during a one- year period. (5) M EDICAL CARE.—The term ‘‘medical care’’ includes mental health care. ( 6 ) O UTPATIENT STATUS.—The term ‘‘outpatient status’’, with respect to a recovering service member, means the status of a recovering service member assigned to— (A) a military medical treatment facility as an out- patient

or (B) a unit established for the purpose of providing command and control of members of the Armed Forces receiving medical care as outpatients. (7) R ECOVERING SERVICE MEMBER.—The term ‘‘recovering service member’’ means a member of the Armed Forces, including a member of the N ational Guard or a Reserve, who is undergoing medical treatment, recuperation, or therapy and is in an outpatient status while recovering from a serious injury or illness related to the member’s military service. ( 8 ) SERIOUS IN J URY OR ILLNESS.—The term ‘‘serious injury or illness’’, in the case of a member of the Armed Forces, means an injury or illness incurred by the member in line of duty on active duty in the Armed Forces that may render the member medically unfit to perform the duties of the mem- ber’s office, grade, ran k , or rating. ( 9 )TR I CARE PROGRAM.—The term ‘‘TRICARE program’’ has the meaning given that term in section 1 0 72(7) of title 10, United States Code.
